Normally I would agree..... Except that the last 25 years have seen an awful lot of activism from the federal bench. By the way any president who doesn't trigger a court case is not working till the full extent of his capacity.... He's going to win this one. The executive branch has every right to look at the records.

Having said that a lot of the constitutional mechanics between the branches are still very foggy even for the sharpest legal minds. The one thing that they won't be able to defend is trying to keep the secretary out of his own records. That is absolutely clear-cut, no debate 100% judicial overreach. He would first have to be convicted of a crime in a court of law and stripped of his privileges. That's not going to happen and he will be back into those records probably in less than a month.

No one is an infallible expert. If judges were supposed to be infallible, there’d be no need for appeals.

Besides. We are talking about a temporary restraining order. It’s just putting a pause on making any changes until the case can be heard and decided. It’s not a ruling. Just maintaining the status quo in a dispute.

So far the United States legal system has shown itself to be fairly self policing. Even the ridiculous sham in New York State pretty much stayed in the state... The other cases that never really had any merit simply fell apart because once the phomy support for them went away there was really nothing left to pursue.

Forbidding the secretary of the Treasury from examining the Treasury records is judicial overreach in its purest form. The secretary could simply ignore the order because it's unconstitutional.... However he's doing the smart thing and waiting for the order to be overturned which it most certainly will be.

There's no question that it's judicial overreach and it will certainly be reversed.

The judge can rule on crimes committed but he cannot rule outside of his own purview that interferes with executive privilege.

The Secretary is in the executive branch and the Treasury is his. Nobody can prevent him from looking at the records. He could do it now.... He's locked himself out but he could let himself back in with absolutely no legal repercussions. His cooperation is a courtesy to the court not an obeisance to it.
