Do Undocumented Immigrants Have Constitutional Rights?

Over the years since 1776, courts have ruled that they do have some rights, but not the full rights citizens have. They do not have the right to possess firearms and, if they go to court for illegally crossing the border, they are not entitled to free legal counsel. Gideon v Wainwright established that criminal defendants charged with a felony get free counsel and illegal entry is only a misdemeanor.

Plyler v. Doe (1982)

‘In Plyler v. Doe, the Supreme Court struck down a Texas law prohibiting enrollment of "illegal aliens"— a dehumanizing term commonly used to reference undocumented immigrants—in public schools.’ ibid

In addition to being dehumanizing, ‘illegal alien’ is also an incorrect description of those undocumented.

“…nor shall any State deprive any person of life, liberty, or property, without due process of law; nor deny to any person within its jurisdiction the equal protection of the laws.” 14th Amendment

As the Plyler Court correctly noted, those undocumented are in fact persons, and entitled to due process of the law.
 
lg325 No..........that was never what was intended. Giving the illegals right, is a new thing of our corrupt government.
Of course, far too many on the hateful, bigoted right oppose this settled, accepted fact of Constitutional law, the consequence of their unwarranted fear of diversity and inclusion and baseless hostility toward immigrants and immigration.
 
Illegal aliens are subject to Constitutional protections while they are in the territory of the United States of America.
 
C_Clayton_Jones Non-citizens (actually criminals and invaders in this case) deserve no constitutional rights...they should be treated as hostile invaders and shot on sight if not sent back across the border.
 
The 14th Amendment states it very clearly. "No state shall ... deny any person within its jurisdiction the equal protection of the laws."

"Any person," not just citizens or legal immigrants or whatever. "Any person" means any person. Yes, as soon as they step into our jurisdiction, they have full Constitutional rights, same as you and me.
