By locked up I take it you mean not convicted of a crime.

But, they can be released by simply agreeing to be flown back where they came from on our dime.

It is the ACLU and leftoid lawyers telling them to stay locked up and not accept the free flight home so the ACLU et al. can fight it while they stay locked up. $$$$$

From what I read on legal sites, that isn't exactly the case. They can get released on agreement to leave the country at their expense by posting the second type of Bond that might be available to them (as there is no bail in these civil misdemeanor federal cases). It is called a Voluntary Departure Bond. I thought, the same as you.

Like I said, if you are here illegal and you have not been arrested by ICE yet, you really should be really be trying to get the hell out, while still in a position to transfer whatever it is, you own to your kids, or sell out, and split. Our illegal immigrant prisons and prison camps aren't getting any better. If you go to one, there is no telling when or if you will get out, as the government can pretty well postpone and reschedule immigration court hearings for the incarcerated, at will.

I defend no criminal aliens. Those with felony convictions deserve to be kicked out (after they have served their time) and it should have been automatic at the gates or the prison, direct into immigrations authorities hands. Like most Americans, I thought and think felonies are felonies, not caring whether violent or white collar, and part of the punishment for an illegal alien's felony, should have been getting kicked out the country and banned from return.

I have no activists, no connections to activist, no contributions to organizations that support activists. This is a more rural, normal part of American. The vast majority of us have no such connections. You should get out more. Staying in your 35% cult bubble, you have lost contact with reality, in your minority status.

Question. Is there any other non-violent misdemeanor offense in the United States, where you can be locked up without bail in a hell-hole prison for 10 (and counting) without a trial? I cannot think of one. Being majorly detained for civil infractions, (most common civil misdemeanor charges being Overstaying Visa, Unauthorized Entry and Violation of Immigration Status) not criminal charges, there is no bail. There is no "speedy" trial, and detainees often have no idea when a trial will be, and trials are often put off by the government with little or no reason, the detainee never knowing when the trial is rescheduled to. There is no right to a government lawyer.

They may (or may not) be able to qualify for either a Delivery Bond or a Voluntary Departure Bond. Both are non-refundable. So maybe they can get out bond of up to $15,000, if they promise to leave the country at their own expense. It is surprising, how many low wage migrant farm workers, hotel maids, cooks and lawn care works, do not have an extra $15,000 non-refundable bond cash, stashed away. So, they may not be able to pay their way to freedom, even if volunteering to leave. They are just stuck, in limbo. Theoretically, mowing grass and trimming hedges could result in a misdemeanor life sentence, for the illegal immigrant lawn care guy.

As for the criminal gangbangers, drug dealers, robbers, pimps, and prostitutes (all of this group being a very small minority of those detained), I really could give a shit, but don't. Though it is kind of rough on the guy that walked across the border doing 12-hour grinds, working for the American owner of one of the taco, enchilada, and tamale lunch trucks for the civil misdemeanor charges. The foreign working stiff was arrested for.

It is unlikely anybody will see any kind of restitution.

They cannot legally get federal welfare or subsidized healthcare, as it is against the funding laws for those programs. Of course, if they commit fraud to get on the dole illegally, it doesn't take many payments to exceed misdemeanor and be charged as a federal Felony. Anybody that knowingly helps them fraudulently get in the system is automatically in for felony conspiracy. They can go to an emergency room to get emergency care.
