Democrat Senator Mark Kelly Faces Court-Martial After Department of War Launches Review of Allegations of Misconduct

What law allows them to refuse to go to the interview?

One can akways escape a perjury trap by simply not committing perjury.*

But yes. Anyone concerned that talking to the FBI could put them at legal risk is welcome to invoke their constitutional right to avoid self-incrimination.

If the FBI shows up to their office, they can refuse to talk.

I'm sure their staff and their families and friends can also refuse to talk. I believe they would each have to invoke their rights individually. They have to be in fear of self-incrimination. They cannot say, "the answer may incriminate my dad," or "my boss", or whatever.

Why do you think I disagree on that point?
They are not under arrest and have freedom of movement.

My God, you are a feckless wonder!

You disagree because you are ignorant. That is all.

No kidding?

You're an ass.
I’m not.

Kelly said military don’t have to follow illegal orders. That’s just a fact.

MAGA is freaking out about it. That’s what’s embarrassing.

If a number of celebrities got together and made a video of themselves reading Article 2 of the Constitution, pointing out areas that trump claims authority over that Article 2 does not give him, would they be investigated? On what grounds?

The Seditious Six poison the ranks

26 Nov 2025 ~~ By Kevin Finn

Much has been written about the brazen display of political theater offered up by the so-called “Seditious Six”. What began as a performative act of resistance has spiraled into a cascade of investigations, threats, and revelations exposing the profound lack of wisdom in their actions — and the grave dangers they pose to military morale, good order, and discipline.
The video’s fallout was swift and severe. President Trump condemned it on Truth Social as “SEDITIOUS BEHAVIOR, punishable by DEATH!” — a hyperbolic reference to historical treason penalties, later clarified by the White House as non-literal. Legal experts point to 18 U.S.C. § 2384, which criminalizes seditious conspiracy with up to 20 years in prison, and 18 U.S.C. § 2387, prohibiting interference with military loyalty. Senator Slotkin (D-MI) announced on X that the FBI’s Counterterrorism Division had opened an inquiry into her and the group, framing it as Trump’s “weaponizing” of federal agencies.

Yet, as Deputy Attorney General Todd Blanche noted, any probe hinges on intent — precisely the murky territory the Democrats entered by sowing doubt about lawful commands without citing specifics.
Alarming repercussions are emerging from the ranks. A JAG officer’s X posts illustrate the video’s toxic ripple effects. Echoing the Democrats’ rhetoric, the JAG officer questioned Headquarters, Department of the Army (HQDA) policy 175-25 — a policy disqualifying those with gender dysphoria from service — declaring she’d refuse orders she “disagrees with”.

It’s a humiliating detail: a veteran lecturing on duty while flouting basic protocol. Hegseth underscored the irony — the Seditious Six, invoking their oaths, now embody the very indiscipline they risk fostering.

~Snip~
We live in an era of heightened national security — urban deployments, strains at the border, and global hotspots — and their video doesn’t “hold power accountable”, it invites mutiny by blurring lawful obedience with personal politics. As the JAG posts show, it’s already manifesting: officers citing it to justify insubordination on policies like gender standards. JD Vance has called it “by definition illegal”.
The wisdom deficit is stark. These are elected veterans, entrusted with guiding the next generation of service members, yet they’ve prioritized partisan posturing over the chain of command that preserved their own careers. The resulting probes could end in courts-martial, threats that chill military justice, and a precedent that good order hangs by a thread of individual whim. In uniform or out, true patriots know: undermining discipline doesn’t defend the Constitution — it endangers the republic it protects.

Commentary:
As usual the Democrat Leftists and their DSA wing continue to insinuate that Trump is doing unlawful actions, while attempting to negate their weaponization of Federal agencies and undermining our military with DEI.
If we keep playing nice with Democrats, it will only get worse than it already is.
We have to face the fact that the enemy is from within and it's Democrats.
The Administration should quickly clean house, humiliate the six political transgressors with every legal sanction possible and simultaneously take care of the “old business” of doing the same to GEN Milley, for his illegal communications with our adversary, the Chicoms.
Anything less will allow their poison to continue to harm the Armed Forces and “set the example” for other agencies.
Sen. Mark Kelly has renounced his oath of a Commissioned Officer.
We should all remember that historically, once the military becomes political civil war is not far off.

Take a look at the differences between the Armed Forces enlisted and officer oaths of office (easy to find on-line).
Oath of Commissioned Officers
I ___, do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; that I take this obligation freely, without any mental reservation or purpose of evasion; and that I will well and faithfully discharge the duties of the office on which I am about to enter. So help me God.

Oath of Enlistment
I, _____, do solemnly swear (or affirm) that I will support and defend the Constitution of the United States against all enemies, foreign and domestic; that I will bear true faith and allegiance to the same; and that I will obey the orders of the President of the United States and the orders of the officers appointed over me, according to regulations and the Uniform Code of Military Justice. So help me God.
(Title 10, US Code; Act of 5 May 1960 replacing the wording first adopted in 1789, with amendment effective 5 October 1962).

It is the fifth amendment that allows them to do that. Unless you know of some other law that gives them the right to remain silent.

Why is that so difficult for you to understand? why would you object to saying that they are taking the fifth? it is every American's right to do so.
Because they only receive their Miranda rights when taken into custody. They are not being taken into custody, even!

I'd agree, however the forum which it was done is at issue.
All a political stunt.

That would be a subject of hot debate.
Sure, call it a political stunt. That’s at least in the realm of sanity.

Trump screaming about executing members of Congress for sedition is embarrassing.

:blowpop:52 pages? really?

this is going to come back & bite donny in his huge orange diaper filed behind.

I completely agree that they do not have to answer questions. I don't know how many times I have to say that before it will penatrate. The fifth amendment says so.

Of course if Mark Kelly is recalled to active duty, he can absolutely be ordered to the interview. But he still won't have to answer questions.

The 5th Amendment says so. Who cares what the voters will think of a Senator refusing to cooperate with law enforcement when suspected of sedition?

deflection denied.webp

Ask him. My guess is that Miller whipped him up into a frenzy and he popped off with his insane tweets.
You know it's political what democrats did here, and now they're going to play the victim and hide behind the First Amendment. You creatures are desperate and sick.
