Democrats, meanwhile, accused Republicans of trying to steal an election from its rightful winner, noting that Mr. Brewster’s win was officially certified by Pennsylvania’s secretary of state and was already litigated numerous times in court.

Ms. Ziccarelli asked the Senate late last week to reject the certification in the race and “conclude the final tally of lawful ballots,” which she says shouldn’t include a batch of ballots from Allegheny County that were missing dates on their outer declaration envelopes, but otherwise correct and proven to have been submitted on time....

Advocating for Mr. Brewster’s seating, Senate Minority Leader Jay Costa, D-Forest Hills, said the state had already certified the results of the race. He added that Ms. Ziccarelli’s challenges had been defeated in the courts and that Republicans were taking a page out of President Donald Trump’s playbook by "trying to re-litigate things that have already been litigated thoroughly and properly for the last two months."

The problem in the 45th District is there is a DISPUTE in court about what ballots are legal and which ones aren't. If the ruling goes one way, the R's win, the other way, the D's do.

The current ruling is from PA's Hand Picked Secretary of State. The incumbent is a liberal extremist.
The election was certified and upheld by the state Supreme Court.

The case is in Federal District Court. The PA Supreme Court is ultrapartisan leftist.
 
Democracy died in the United States on November 3rd 2020 when the Democrat filth, helped by China Joe's buddies, stole a national election.

Edit - Actually Trump was ahead on Nov 3rd. Ahead by quite a bit. It wasn't until the 4th that the Democrats stole it.

The Senate quickly dissolved into chaos.

Democrats in the Senate began protesting — in some cases, shouting — after the Republican majority refused to seat Sen. Jim Brewster of Allegheny County, a Democrat whose election was certified by the state but is being contested by his Republican challenger, Nicole Ziccarelli.


Republicans then voted on a motion to remove Lt. Gov. John Fetterman, a Democrat, as the presiding officer, after Fetterman insisted that Brewster be seated with the other senators. They then voted through another motion to recognize the election in every Senate contest, except for Brewster’s.

Republicans have not said how long they will take to review Ziccarelli’s election challenge before voting on it, or how long the GOP majority is willing to leave the seat vacant. The open seat does not affect the balance of power in the Senate, where Republicans hold 28 of 50 seats.

Gov. Tom Wolf, a Democrat, has issued this statement on Brewster not being sworn in today:

“Republicans in Pennsylvania and nationally have spread disinformation and used it to subvert the democratic process. Sen. Jim Brewster rightfully won the 45th Senate District, but Senate Republicans are ignoring the voters in the district and refusing to swear him in as Senator. This is a shameful power grab that disgraces the institution.
“It is simply unethical and undemocratic to leave the district without a voice simply because the Republicans don’t like the outcome of the election. Voters, not Harrisburg politicians, decided this election, and Sen. Brewster is the rightful winner.
“All ballots were counted and certified, and the results are accurate. Sen. Brewster received the most votes in this race and should be sworn in as the Senator for the 45th District. There is no precedent, and no legal rationale, for failing to do so.
“I will do everything in my power to ensure that voters have the final say in elections.”
The state House begins the session with 113 Republican seats and 90 Democratic, although one of those GOP districts is vacant because of the death on Saturday of Westmoreland County Rep. Mike Reese.

Originally brought by Republican Pennsylvania Senate candidate Nicole Ziccarelli against Allegheny County, the challenge opposed the counting of 2,349 mail-in ballots that arrived by Election Day but were missing dates printed by voters on the outer envelopes.

They were received on time. What could possibly invalidate one of those ballots because the voter forgot to put the date on the outer envelope? Everything else was entirely in order. It's nitpicking and that is why the court said forget it.

But good luck. Even federal judges appointed by Trump haven't been favoring these specious suits.
