yes, but emergency powers is being denied by the trade court? They are denying POTUS powers of tariff for the reason
once IEEPA is invoked they still find POTUS do be denied authority by use of tariffs
Maybe im reading that too broad. But their determination as a civil court could be valid and still not check POTUS power to tariff .It does throw a monkey wrench into negotiations.
The ruling is overbroad, and it exceeds their power.

This will be stopped by SCOTUS.
 
Last time I heard that was when republicans were saying the supreme court would overturn Obamacare.

The court ruled that congress had that power, because congress alone has the power to impose taxes.

It has been said all along that Trump doesn't have the authority to do this. But the ignorant Boi King™ did it anyway.

Should we have good trade deals? Obviously. But this isn't how it's done. Sorry. That's not the way it works in America. A President can't slap the term "emergency" on every situation on which it wants to circumvent the Constitution. That's how Trump's second term has been run.

And now, because he is incompetent and profoundly damaged, he's destroyed important relationships that we've been building since the end of World War II.

He is a buffoon, a national disgrace and a menace.

  • Trade Act of 1974 (Section 301), permits the President to impose tariffs to address unfair trade practices by foreign nations.
  • International Emergency Economic Powers Act (IEEPA) of 1977, grants the President authority to impose tariffs during national emergencies.
That bill also allows congress to override any decisions the president make and to revoke that authority at any time. It also establishes certain guidelines.That the president has to follow in setting tariffs, which Trump has refused to follow.

Okay then, why would they need to pass a bill attempting to override his tariffs? Yeah, remember that? Of course not. Nobody arguing against them does. Congress knows it gave the power to the president. The courts are wrong, as are many leftists on this thread. Think about it. Observe Congress's behavior. They gave him the power, or they wouldn't be attempting to take it back.

Simple matter of observation.

The bill you cited requires the president to follow guidelines set by congress which trump is not following. It allows for congress to override any and all decisions made by the president when dealings with tariffs if Congress does not believe they are good for the country. It does not give the president the authority to unilaterally pass bill pass any tariffs he wishes without oversight.

Congress knows it granted him the power, otherwise, they would not have attempted to override him.

They have to cite clear law and precedent showing that limit, which they did not do. Free them and weep kids.
 
Now we know just how deep the establishment is. Once it just existed in DC and focused on the DC swamp. After all we have seen, it seems the neo-left want to strip all the power of a POTUS and render them just figureheads who do exactly what the establishment wants. Like they did with Biden. That really begs the question "Which is the party of democracy?"
