But that was was overruled in September, leaving Sullivan to decide on the motion on his own.
Which he was still in the middle of, when Trump issued Flynn a pardon (Nov 25). Which is why Sullivan dismissed it 14 days later (Dec 8)

There was 3 judge panel that ordered it to be immediately dismissed, Sullivan asked for and en banc hearing (meaning all the judges of the circuit), they said, hey you can't order it dismissed, we have to remand it back to the lower court and order the lower court to take up the motion, and they said do it quickly.
