WASHINGTON – Nineteen conservative states filed an emergency appeal to the Supreme Court on Monday asking the justices to retain a pandemic policy known as Title 42 that allows the federal government to rapidly expel migrants over concerns about public health.

Put into place by former President Donald Trump and extended by President Joe Biden, the policy was set to expire on Wednesday, but some critics have said lifting it would create chaos at the border. The Title 42 authority has been used to expel migrants more than 2.4 million times since its implementation in early 2020.

After being denied a request by a federal appeals court on Friday, the states are now asking the Supreme Court to temporarily block a lower court ruling that found the policy's implementation violated the law. The filing was announced by Arizona Attorney General Mark Brnovich.

Chief Justice John Roberts temporarily freezes order meant to end Title 42 Wednesday​

Supreme Court Chief Justice John Roberts on Monday put a temporary hold on the termination of a controversial Trump-era immigration policy known as Title 42 that was set to end on December 21, leaving it in place for now.

But in a brief order Roberts signaled that the court wants to act quickly and asked the Biden administration to respond by 5 p.m. ET Tuesday to an emergency appeal filed by a group of Republican-led states.

The states had raced to the Supreme Court earlier in the day in an emergency bid to keep in place a Trump-era immigration policy that is set to go off the books Wednesday.


The policy allows officials to swiftly expel migrants at the US border and was vacated last month by a federal district court judge who called Title 42 “arbitrary and capricious.” The judge said the program could remain in effect until December 21.
