The Canadian Broadcasting Corporation is reviewing complaints from both Americans and Canadians about a Web site columnist who recently described Sarah Palin’s supporters as “white trash,” compared the vice presidential candidate to a “porn actress” and called her daughter’s boyfriend a “redneck” and “ratboy.”

The incendiary column by Toronto-based writer Heather Mallick appeared on the CBC News site on Sept. 5, after the close of the Republican National Convention. On the same day, Britain’s Guardian newspaper published another column by Mallick in which she trashed Palin’s home state of Alaska as a “frontier state full of drunks and crazy people.”

In the CBC story, Mallick wrote that John McCain’s running mate “added nothing to the ticket that the Republicans didn’t already have sewn up, the white trash vote.”

The constitutional provision that guarantees Freedom of expression in Canada is section 2(b) of the Canadian Charter of Rights and Freedoms.

2. Everyone has the following fundamental freedoms: ... (b) freedom of thought, belief, opinion and expression, including freedom of the press and other media of communication

Due to section 1 of the Charter, the so-called limitation clause, Canada's freedom of expression is not absolute and can be limited under certain situations. Section 1 of the Charter states:

The Canadian Charter of Rights and Freedoms guarantees the rights and freedoms set out in it subject only to such reasonable limits prescribed by law as can be demonstrably justified in a free and democratic society. (emphasis added)

This section is double edged. First it implies that a limitation on freedom of speech prescribed in law can be permitted if it can be justified as being a reasonable limit in a free and democratic society. Conversely, it implies that a restriction can be invalidated if it cannot be shown to be a reasonable limit in a free and democratic society. The former case has been used to uphold limits on legislation which are used to prevent hate speech and obscenity.[citation needed]

In the landmark Supreme Court of Canada case R. v. Zundel (1992), the court struck down a provision in the Criminal Code of Canada that prohibited publication of false information or news, stating that it violated section 2(b) of the Charter.

Under section 318 of the Criminal Code of Canada, it is illegal to promote genocide. Under section 319, it is illegal to publicly incite hatred against people based on their colour, race, religion, ethnic origin, and sexual orientation, except where the statements made are true or are made in good faith. The prohibition against inciting hatred based on sexual orientation was added to the section in 2004 with the passage of Bill C-250.

Other laws that protect freedom of speech in Canada, and did so, to a limited extent, before the Charter was enacted in 1982, include the Implied Bill of Rights and the Canadian Bill of Rights.

For the record, the daughter's boyfriend is a self-proclaimed Redneck who will "kick your ass" or least that was according to his myspace before he took it down. :eusa_whistle:
 
If calling people white trash were an illegal hate-crime in America Obama would not have enough voters left to make it into the local PTA (not that he's experienced enough).
 
Just to clear up a misconception, the CBC is not a government controlled news source. The head of it is appointed, but not like an appointment that we would have ie: someone who may not have a clue as to the job, but someone who has likely managed a major business and has had a considerable amount of journalism experience.

The government can't fire anyone. it's completely independent. The head of the CBC can fire her, though.

We're not talking about Pravda here, people...

you cannot control anyone else's actions.
 
i have found canadian news to be less censored than american news. they make fun of the us ...most of the time. It is pretty funny really. I am not shocked this was said on government sponsered canadian tv.
 
It's like I say... The people who fight for tolerance are the least tolerant people... Liberals are huge hypocrits... Look at the women's groups who are no longer for women, there are just for liberal women... Look at the minority groups. They are not for all minorities, just liberal minorities...
