Corthoris Jenkins, 28, was playing video games in his North-Miami Dade apartment Tuesday when Xavier West allegedly broke into the efficiency unit, the Miami Herald reported. Jenkins grabbed an assault-style rifle and chased West, who was unarmed, from the home, prosecutors said.

Jenkins is accused of shooting West several times while he was on his knees. It was unclear if the men knew each other.

“He begins to, what appears to be, to beg for his life,” Miami-Dade Detective Iry Watson told a judge Wednesday afternoon. “But the defendant takes the assault rifle and shoots him multiple times.”
Now I do not feel even the slightest bit of sympathy for Xavier West, but he should have gotten shot in the doorway. Once he was on the run I can understand pursuing him to make sure police get him, but if he is on his knees? That's going to far.


The case could be another legal test for Florida's Stand Your Ground law, which opponents argue encourages vigilante-style justice, the Herald reported. The law became a national focal point after the 2012 killing of 17-year-old Trayvon Martin.

The 2 incidents aren't even remotely similar. Trayvon was still a piece of shit of course, and was in the act of committing a violent assault when he was converted to fertilizer. That's the only contribution he ever would have made to the planet anyway. In this case you have a piece of shit that had surrendered. Castle Doctrine also does not apply here because the defendant was not being threatened. Jenkins had effectively arrested the suspect for all purposes of law and could have waited for police to come collect West. It looks like Jenkins shot West out of anger. He should have been charged with Aggravated Assault rather than Attempted Murder IMO.

Actually they are similar: the unwarranted, unprovoked pursuit of someone who posed no threat to the armed individual.

Once Xavier West fled the dwelling, Jenkins was no longer in danger, West’s killing was unjustified.

Likewise, Trayvon Martin posed no threat to George Zimmerman, Zimmerman’s armed pursuit of Martin was also unwarranted, unnecessary, and unjustified.
