BREAKING: Supreme Court says US must aid in return of man deported by mistake

Anybody willing to take a wager on how soon this guy comes back to the U.S?

Keep in mind the Trump administration only has to "facilitate" his return, not "affectuate" his return.

Anyone willing to bet it will before Summer?

He's not going back to Gitmo, and there's already been a trial. He will be set free which was the outcome of his trial.
There hasn’t been a trial yet you fucking moron. There’s nothing in the order that gets him home and set free. He can be brought back for the trial that will deport him. He will be held in jail until it’s proven he’s illegal and has no right to be here. Then he gets our last tax payer funded flight back to El Salvador.

I'm just gonna put this out here, politely:

If the administration would adhere to proper procedure, there would be no need for this constant flow of lawsuits. This is one example. There may be others, and don't tell me there aren't. This hasn't been executed flawlessly.

Nope, not at all. The government must 'facilitate' bringing him back. Not a gang leader.
Fuck him.

Just crossed the wire.

Essentially, they said the US must aid in the return of a man whom was deported "by mistake" back to the US. Yes, Trump made a mistake here. Yes, the Supreme Court nailed it.

If you have links post them below.
A feel good story. We should in fact make efforts to correct a mistake.

It's at the discretion of Congress whether to impeach him. I don't see that happening with the current makeup of the House.

If, somehow, Democrats do succeed in forcing Trump to bring back this illegal alien who is a suspected terrorist gang member, the makeup of the Congress will even be more lopsidedly red after 2026.
For some reason you don't seem to get it. The issue is not whether he should be allowed to stay in this country. The issue is whether he will have the right to due process which ever person in this country is entitled, not just American citizens.

If you can deny his rights, then where do you draw the line.

Why are you people advocating for this guy... you don't rise to the top of MS13 without having killed someone... WHAT THE HELL IS WRONG WITH YOU?....
Stop lying . Heonotceven a member of that gang

That’s why it was a mistake stupid

This is just the beginning.

Our tax money is going to make a lot of these guys wealthy because of trump. All that money they were supposed to be getting from welfare is a pittance compared to the millions some of these guys are about to get from our government. It would have been better to let them stay here illegally and get whatever benefits the right claims they get, than the payments the courts will make the government pay. This is the price of racism.

US Supreme Court upholds order to facilitate return of deportee sent to El Salvador in error

The U.S. Supreme Court upheld on Thursday a judge's order requiring President Donald Trump's administration to facilitate the return to the United States of a Salvadoran man who the government has acknowledged was deported in error to El Salvador.

U.S. District Judge Paula Xinis on April 4 issued an order that the administration "facilitate and effectuate" the return of Kilmar Abrego Garcia, in response to a lawsuit filed by the man and his family challenging the legality of his deportation.

What the Court actually said:

The rest of the District Court's order remains in effect but requires clarification on remand. The order properly requires the Government to "facilitate" Abrego Garcia's release from custody in El Salvador and to ensure that his case is handled as it would have been had he not been improperly sent to El Salvador.

The intended scope of the term "effectuate" in the District Court's order is, however, unclear, and may exceed the District Court's authority
.

He had his due process under the Expedited Removal Law.

You're hung up on thinking that "due process" always means a court, a jury, lawyers on both sides, right to subpoena witnesses and right to discovery of evidence.

That's not the due process for the deportation of a known illegal alien.

There is as much evidence that youre in MS13. Maybe you should be deported?

Sad for you but the right-wing supreme court says you are full of shit.

Bring him back and deport him to Ukraine. He can fight to defeat the Russian Empire and free Ukraine from occupation.

It's win/win.
Assuming this is the United States and not vigilante land, we do have laws which require that a deportee be returned to his home country. Andry José Hernández Romero is a native of Venezuela and that is where he should have been deported. Legally we can not send deportees to war zones, throw them out of planes, or execute them.

He will just be deported again if he is brought back.

This is yet another hill lefties are willing to die on.

The same people who had no problem with J6ers languishing in prison for years without a trial.
Maybe because they entered guilty pleas? FAFO

They sent it back to the lower court for "clarification."

I'm laying odds that he will not make it back to the U.S. A. by Summer. Care to take me up on it?

If he manages to make it back, before summer or in three years, nothing stops the Trump admin from removing him immediately under the Expedited Removal law.

  • Due Process: ensures that the government follows fair procedures before taking actions that could deprive someone of life, liberty, or property.

Examples include the right to notice, the right to be heard, the right to present evidence, the right to cross-examine witnesses, and the right to legal representation.
"Due Process is the cornerstone of our democracy"

If he hasn't been killed already. The incompetence of this regime is mind blowing. Crashing the economy, bowing to Putin and Russia, and dragging people off the street and sending them to other countries.
He may NOT be alive which is why Trump & his goon squad are fighting tooth & nail in the courts to not be ordered to bring him back here.

The real criminals are Trump, Bondi & the rest of them who broke the law by deporting him in the first place.
