I remember this case..

He was punished for serving the Chic-Filet sandwiches.. this was during the time frame of the Gay protests of the company and there were at least one gay or gay supporting member of the band who was offended because of the choice of food and filed a complaint.

As they absolutely should've done. Chick-fil-A is a bigoted company, and its food is tainted by racism, homophobia, and religious zealotry.

This manpig is just angry because President Obama's Army isn't tolerating his public bigotry (hatred of Homosexual-Americans, racism against President Obama) any more.

His lawsuit will fail. I guarantee it. Not just because I want it to, but because no court could possibly uphold the claim that, in the midst of military down-sizing, this bigot was forced out due to "muh political buhleefs" or "muh relijun".

Josslyn Aberle, a spokeswoman for Military District Washington: “The soldier received due process from the military in addressing complaints [and] allowing the appeal processing for the QMP board, which determined the soldier didn’t meet the qualification for retention on active duty.”

Master Sgt. Sommers first came under fire for bumper stickers on his car that read, “NOBAMA” and “The Road to Bankruptcy is Paved with [expletive]-Fault,” accompanied by a picture of a donkey. He was told by superiors to remove the stickers, Fox News reported.

Master Sgt. Sommers was also criticized for reading books written by conservatives like Sean Hannity, David Limbaugh and Mark Levin, while wearing his military uniform. At one point, Master Sgt. Sommers said he was backstage at a scheduled performance, in uniform, reading “The Great Destroyer” by Mr. Limbaugh, when a superior officer told him he was causing “unit disruption” and to put the book away, Fox News reported, citing the suit.

The DoD changed the rules about Political Bumper stickers years ago.

He did push the envelope when he served up Chic Filet A " Celebrating " the end of DADT

“In honor of [Don't Ask/Don't Tell] repeal, and Obama/Holder’s refusal to enforce [Defense of Marriage Act], I’m serving Chick-fil-A at my MSG promo reception for Army today.”

But that doesn't violate any DoD or Army Regulations.

BTW, no one was told they had to stop reading books supporting Obama or Obama's books. Nor was anyone told to remove Pro-Obama bumper stickers.

Whether he is on duty or not, an active duty member of the US military is under the UCMJ. His rights are certainly not the same as a citizen who is not in the military.
