He was charged by Art 15 three counts, found guilty of failing to go to an appointed place of duty, disobedience of an order and making a false official statement.

I will be interested to see how this case turns out. Those superiors that ordered him to, a) get rid of the bumper stickers and; b) stop read conservative material in front of other military personnel could just lie under oath.

What really hurts him is the fact that he took the retirement willingly. He should not have done that and made them boot him out. I think, then, he would have won his case.

I really don't think a soldier gives up his rights as a citizen when not on duty. His personal car and the Chic Filet was on his personal time.

Whether he is on duty or not, an active duty member of the US military is under the UCMJ. His rights are certainly not the same as a citizen who is not in the military.

That seems hardly fair. He is fighting for our rights and he doesn't enjoy them himself.

How does a Sailor who spent nhis military career chipping paint get a retirement ?

There are a couple of quotes that defintitely speak against MSG Sommers' claims:

“In honor of DADT repeal, and Obama/Holder’s refusal to enforce DOMA act, I’m serving Chick-fil-A at my MSG promo reception for Army today,” he tweeted.
and
Sommers told me he paid for the party with personal money, not government funds – and for the record – he served the sandwiches because his family likes to eat more chicken.

“I had no idea a Chick-fil-A sandwich would get me in trouble,” he said.
He was clearly trying to make a political point, publicly objecting to the actions of his Commander-in-Chief. You cannot reconcile his tweet with the claim that he just wanted to eat more chicken. That's an old old trick...to do something obviously provocative and then claim you had no idea.

That alone makes me question his honesty on the rest of the incidences.

I have a very good idea of how the army works and no, he would not be retiring as a PV1 with just a bad record. It would take a court martial to reduce a MSG to PV1 or PV2 and that's more than just a "bad record." But it is very common to allow someone to retire in lieu of court martial or further administrative action.

As they absolutely should've done. Chick-fil-A is a bigoted company, and its food is tainted by racism, homophobia, and religious zealotry.

This manpig is just angry because President Obama's Army isn't tolerating his public bigotry (hatred of Homosexual-Americans, racism against President Obama) any more.

His lawsuit will fail. I guarantee it. Not just because I want it to, but because no court could possibly uphold the claim that, in the midst of military down-sizing, this bigot was forced out due to "muh political buhleefs" or "muh relijun".
