There is the practical side of me that strongly suspects this as false hope as there is no federal law guiding when autopen can and cannot be used.

The hopeful side of me anticipates that President Trump is right. If Biden didn't know about and authorize those pardons, then of course the autopen was used fraudulently and would be invalid. The problem will be proving that he did not know and did not authorize the pardons.

It is possible that it could land on SCOTUS's desk to decide.

But yes, it would be deliciously satisfying and so enjoying to watch all those scoundrels lawyering up.

The president decides when a pardon is needed. In this case, Biden knew it was needed to prevent Trump’s DoJ from engaging in partisan persecution of their perceived enemies.
