The state action doctrine which is the dominant legal view is that the first amendment applies only as a constraint on government, not citizens and non government controlled organizations/entities. That said, I can think of a few non-speech crimes the a-holes could be charged with if they did that crap in this area.Actually...it is freedom of expression out side the GOV but it melt into free speech.
