It doesn't matter. The police have no obligation to determine whether any arrest can be prosecuted. They arrest. The prosecutor reviews the evidence and determines whether there is enough to charge an offense. The police don't do that.the arrest was made after reviewing the video.The prosecutor never thought he had a case. The police made an arrest based on a claim of misdemeanor battery. As soon as the prosecutor got the case it was kicked.So the real question is this, if the video exists, and it disproved the claim, why did the democrat prosecutor feel he had a case?
