I just heard an attorney on a local radio show make a very odd announcement on the law and its teeth.

According to him:

There will be a box on your tax form that asks if you have health insurance.

If you check no you must add the appropriate amount to your taxes. 695.00 was the figure he gave.

If you check yes you have to offer NO OTHER PROOF OF ANY KIND

If you are not audited it goes no further.

If you are and you were found to be lying the only thing you face is the original fee. No penalty for lying whatsoever just the fee. IF YOU'RE AUDITED.



This is not only insane it is the future bankruptcy of our system. Most of the people that are insured already will contribute nothing. Those that aren't will have the option to lie thus no funding is raised for the program. Thus ballooning our debt big time.

I can not provide any links to this information as I haven't had any time to look but I wanted to post it before I forgot the details of his interview.

Is this accurate? Are our elected officials this stupid? Or was this intentional?

Are democrats actually expecting the poorest among us to work on the honor system despite the fact that it will make them poorer?

It would be up to the IRS to verify that individuals are complying with the health insurance mandate, and to collect the tax penalty from them if they aren’t. Both the House and Senate bills contain sections that would amend the Internal Revenue Code and require either health insurance companies or employers to provide individuals with documents containing the specifics of their insurance coverage (e.g., name(s) on the insurance policy, period of insurance coverage, etc.). Individuals would then submit that information with their federal tax returns as proof of coverage. The IRS would be responsible for verifying that health insurance is acceptable.

...but it's from 2010. Don't know if it's still accurate.
 
I am pretty sure the Same Tax Evasion/Defeat Laws would apply as well as Penalties and Interest. This law does not have to have specifics of how that will be dealt with when we already have laws on the books about it.

Assuming for a moment that this is accurate, how is it going this going to create debt? The purpose of the penalty is to induce people to buy insurance, and in most cases the penalty will be more expensive than actually buying insurance. So the design is intended to have NOBODY paying the penalty.
 
All our taxes will be going up thousands a year no matter what. That's what the right wingers say

I suppose this will be the general way to check and for those without employer insurance another section and verification would be needed. Probably from the issuer of insurance.

695.00 is about one months premium cost to those of us who actually pay for private insurance. What this means is that most people who already do not buy it, won't and will opt for the tax. So this does nothing to actually pay for all the freebie insurance that everyone will get, but it does expand the governments control over our money and add to medical costs...Obama care is a boondoggle...

If one can not afford health insurance, it will be provided for him by his state’s Medicaid program. He’s thus covered and not subject to any tax.

And if one already has health insurance, this is not an issue.

The tax would apply only to those whose incomes are sufficient to afford health insurance, or where it’s offered at their place of employment, and they refuse to participate.

Then you're getting ripped off, or have opted for more expensive coverage. Also, the $695 figure is for an individual with no dependents, and is only applicable for one year. After that, the penalty rises to a little more than $2k.

That's not entirely accurate. A person who makes below a defined amount will be eligible for government provided insurance. Just because someone makes a little more than that doesn't mean that they can afford health insurance. Specifically, a single person who makes $15,000 a year pre-tax (would come out to about $12,500 a year after tax) would not qualify for government insurance, and would be required to pay for his own health insurance. I wouldn't exactly say that a person making that much money is going to be able to easily afford insurance.

I am not getting ripped off- I do purchase good coverage.

the penalty is so low its a joke, not much impetus to purchase there, if you cannot be refused and just drop in to a policy when you are messed up, and no documents ala 'No Docs'? where have we heard that before?:rolleyes:
 
Medicaid for those earning less than 133% of the poverty line ($15k individuals, 30k family of four), subsidies for up to $88k family of four. The only people worse off are health care scammers- Pubs and their cronies.
