Judges have to enforce the law. They are agents of the state. They have NO RIGHT to disregard the law simply because they do not personally agree with it. If they refuse to perform their duties for personal reasons then they need to resign.
What if a judge in a murder trial opposed the death penalty and refuses to charge the jury with instructions related to the death penalty due to his personal beliefs? What if a jury imposes the death penalty (in a state where this matter goes to the jury) and the judge refuses to impose the sentence based upon his personal belief? Are you ok with that? I sure as hell am not.
