Friday Night News Dump: No DOJ discipline for authors of Bush “torture memos”

Seven years after the memos were written, it’s finally over — almost. Conyers is promising to hold hearings about the report issued tonight, with John Yoo and Jay Bybee called as witnesses, to give the left some small measure of victory. They can’t get satisfaction at the DOJ or in the polls, but maybe watching House progressives berate Team Bush — even while The One lets Pakistani intel work over those captured Taliban chieftains — will scratch their itch for moral vindication.

The conclusion resulted from a decision by top career Justice Department executive David Margolis to reverse a recommendation of investigators that found the two lawyers’ legal memos did constitute professional misconduct. That tentative conclusion, which was overruled by Margolis, said the lawyers should be referred to their state bar associations for potential disbarment.

But in the final report, the examination of the legal guidance written by Justice Department lawyers John Yoo and Jay Bybee found they did not constitute a professional breach that could have led to state disbarment…

In addition to the content itself, the constantly delayed release of the politically sensitive report had become an issue. Issuance of the report was repeatedly postponed for more than a year, prompting lawmakers and civil liberties groups to press for publication of the investigation’s findings. In November, Holder told Congress the report would be made public “by the end of the month.”

The usual Friday night Obamaland hijinks, however, will not obscure this episode of shoddy partisanship on the part of the Justice Department's Office of Professional Responsibility, which both concocted a baseless legal ethics complaint against distinguished lawyers from DOJ's Office of Legal Counsel and then, in OPR's own stunning ethical lapse, leaked all manner of information about it over the last year.

Miguel Estrada, counsel for John Yoo, released this statement:

After a years-long investigation, the U.S. Justice Department today rejected a Final Report by the Office of Professional Responsibility purporting to find that Professor John C. Yoo, a distinguished legal scholar in one of our Nation’s finest universities, was guilty of professional misconduct during his tenure as Deputy Assistant Attorney General in the Office of Legal Counsel. In our written submissions to the Department, we demonstrated in great detail how the various versions of the OPR report reflected shockingly substandard legal work and a deep partisan bias. We are pleased that the Justice Department, at long last, has agreed with the bulk of our criticisms...

... OPR’s work in this matter was shoddy and biased. The only thing that warrants an ethical investigation out of this entire sorry business is the number of malicious allegations against Professor Yoo and Judge Bybee that leaked out of the Department during the last year. It is high time for Attorney General Holder to show that these leaks were not authorized or encouraged—for base partisan purposes—at the highest levels of his department. Mr. Holder can do so by identifying the culprits and referring them for prosecution or bar discipline, as appropriate.

Does anyone really care what the Worst U.S. Congress in history thinks anymore? Let em hold all the hearings they want. Hopefully their day is just about done. Make 2010 count people.
 
The American people are so glad that the worst administration in over a 100 years that went out of power in 2008 ensures they will give BHO some more time to try to make good. Too bad the torture apologists get to skip but, like Nuremberg, the record is documented for history. The failed leftist neo-cons will not escape the verdict of history.

A new CNN poll contains some troubling numbers for President Obama. Among Americans -- and those registered to vote -- 52% believe Obama does not deserve a second term, while 44% think he does. A paltry 4% don't have an opinion on the matter.

Pay no mind to Jane Malarky. She's one of those left wing clowns trying to pose as a conservative who's trying to clean up their party. It's all an act. Exposed long ago. She's as significant in life as the steaming turd my dog laid out on the lawn this morning.
