Federal appeals court deals blow to President Obama’s amnesty

A federal appeals court upheld an injunction against President Obama’s new deportation in a rulingTuesday that marks the second major legal setback for an administration that had insisted its actions were legal.

The U.S. Court of Appeals for the Fifth Circuit ruled in favor of Texas, which had sued to stop the amnesty, on all key points, finding that Mr. Obama’s amnesty likely broke the law governing how big policies are to be written.

“The public interest favors maintenance of the injunction,” the judges wrote in the majority opinion.

"The court of appeals merely held that the district court did not err when it held that Texas had standing to sue," he said. "The true test will be on the merits of the case. That could be a few years down the road, after a trial." In other words the court appeals did not review the case, they just held that district court made no legal errors in their ruling.

Foreigners who violate the terms of their visa may be sentenced to up to six years in prison . Foreigners who misrepresent the terms of their visa while in Mexico -- such as working with out a permit -- can also be imprisoned.

Under Mexican law, illegal immigration is a felony. The General Law on Population States…

"A penalty of up to two years in prison and a fine of three hundred to five thousand pesos will be imposed on the foreigner who enters the country illegally."
