“If any president had done what the [New York] Times reported about the content of the Bolton manuscript, that would not constitute an impeachable offense,” Dershowitz said during lengthy remarks from the Senate floor Monday night.

“Let me repeat: Nothing in the Bolton revelations, even if true, would rise to the level of an abuse of power or an impeachable offense. That is clear from the history. That Is clear from the language of the Constitution,” Dershowitz continued.

Dershowitz made many good points, but his conclusion was dishonest. Dershowitz said the legal consensus was high crimes and misdemeanors required a crime. Not true. The consensus is that “high crimes and misdemeanors” does not require a crime.

The framers were smart. High crimes and misdemeanors had a meaning in English common law. Even the word misdemeanor implies petty offenses. Dershowitz touched on this, but the framers did not have to use that word.

The term in my opinion was left somewhat vague for a reason.

Yep. And the reason is, those in high office have the position and the power to perpetrate wrongdoing the commoners cannot, and which may therefore not be prohibited by ordinary criminal law.

Had the Founders thought a crime were necessary for impeachment, they would have said so. If they thought it should have been a severe crime, they would have added a threshold, like, crimes that carry at least one year of imprisonment as penalty.

Of course, the finest line was, even if the reporting on Bolton's book was correct, demonstrating a quid pro quo, it wouldn't be impeachable. When, in fact, a quid pro quo by necessity involves bribery, something of value solicited for the performance of an official act. The good professor needs a reminder that this word, bribery, is mentioned in the Constitution.

Dershowitz quoted Federalist #65, and there we find, among other deliberations, this:

The necessity of a numerous court for the trial of impeachments, is equally dictated by the nature of the proceeding. This can never be tied down by such strict rules, either in the delineation of the offense by the prosecutors, or in the construction of it by the judges, as in common cases serve to limit the discretion of courts in favor of personal security. [...] The awful discretion which a court of impeachments must necessarily have, to doom to honor or to infamy the most confidential and the most distinguished characters of the community, forbids the commitment of the trust to a small number of persons.​

So, the strict limits, Hamilton claims, imposed on prosecutors before a court of law, namely, only statutory crimes may be applied to the defendant's case, do not apply to the Impeachment proceedings. And, because the prosecution in cases of Impeachment is not limited by the narrow confines of statutory law, there by necessity results an "awful discretion", which again points to misconduct far broader than that captured by the criminal code. In other words, Dershowitz is wrong.

Dershowitz ends up being a puddle of sleaze proclaiming he's taking a stand in the Senate defending the Constitution, not defending Trump, when defending Trump against the Constitution is quite clearly what he was doing.
