Also, the boy does appear to have broken into the property, by scaling the fence, however, he wasn't inside the residence when he was shot. All the man needed to do was to keep an eye on the rear door and phone the police. He could have shot the boy if, and only if, he entered the property.

He is being charged because his life was not threatened. Someone comes onto your property, your life is not in danger until the assailant comes face to face with you.

Maybe at the socialist commune where you may live, you have no individual property (or freedoms).

In the free world here, if someone lives near bad people, and they are indentified as being a definite threat, you have the right to protect yourself and your belongings. This kid obviously wasn't Little Lord Fauntleroy and "unarmed children" can still beat your skull open as the late Trayvon Martin proved.

I don't know about you, but I don't go around after dark in my neighbor's yard or try to enter their homes without permission. If I was so evil to do such things, I would expect to be shot.

away, evidenced by the distance between the blood found on the ground and the single bullet casing outside Landry's house in the 700 block of Mandeville Street.

Landry told police that he approached the boy from his front yard, near his vehicle. As he grew closer, he said, the boy made a "move, as if to reach for something" -- possibly a weapon -- so Landry shot him, the warrant states.

NOPD Detective Nicholas Williams spoke with an unidentified witness who gave an account that differed from Landry's, though the detective did not specify how. Williams wrote in the warrant that Coulter was not trying to enter Landry's house and did not pose an "imminent threat" to Landry.

Then again, I suspect that there may be some wiggle-room in relevant Castle Law and Self-Defense Law, for the shooter to squeeze through; something I read about enabling the homeowner to utilize lethal force to prevent a break-in; not just react to one.

If... IF... true, then the shooter may have a bail-out position or loophole, after all. We'll see.

Personally... I hope the guy gets-off scot-free... I think he may have made a 'bad call' on the shoot, myself, but I completely understand how that happened... given the presence of a dark-skinned (difficult to see in the dark) intruder having hopped the fence and penetrated into a back (side?) yard only a few feet from the doors and windows of the house where his little daughter and pregnant wife were sleeping... and given a Man's Instinct to protect his loved ones and his castle.

Do we realize what this will to lead to if it keeps up? Yes, it will lead to a serious reassessment of the right for every fool in America to have a gun and to shoot first and ask questions later. It will lead to equality in that if a black person shoots a white person or a white person shoots a black person, they will be arrested and treated equally by the law. That's what it will lead up to. Always been on the fence on this one.

You have to do what you can to end the encounter w/o shooting.
Will drawing the gun and issuing a final warning do this? If so, do you not have a duty to do this before firing?

In some cases, the answer is clearly no - the other person is already attacking you, closing distance, etc - but some cases are less clear.

Follow me here. That kid was a thief. He jumped a fence. That's it at that point. Ok. A different kid who is not a thief lost a ball and jumped that same fence. The reason why YOU don't make that call to shoot at that point. the law does.... Is so people don't die for no reason. He should have waited until that shit stain broke in and then shot him in the brain.

The dumbass, thieving kid climbed somebody's 7-foot fence at 2am, to penetrate their yard.

And, if you look at a photo of that yard...

...it's really more like a SIDE yard than a BACK yard, butted-up against a skinny, elongated house that seems to run most of the way back to the rear limit of the property.

With the windows and doors (access to the interior) mere feet, rather than yards, from where the perp was standing in the driveway / side-of-the-house.

And if the kid was already back by the car (which can be seen here towards the rear of this smallish property), then, it's a good bet he was either looking to break into the car or the back of the house, where he could not be seen from the street.

Personally, I think the guy has stretched the limits of the Castle Law or Self-Defense about as far as it can be stretched, and he most certainly could have saved the kid an injury and himself the criminal-legal problem if he had done things in a more clean-cut manner, and he is, indeed, responsible for his use of that firearm, however, I continue to believe that sufficient wiggle-room may exist in those laws, for the shooter to squirm through.

We're gonna find out, soon enough, one way or another, anyway.
