If you suspect someone of drinking you should base the stop on erratic driving.
They pull you over for some minor offense and fish to see if they can pin something major on you

And a person is free to continue on their way, which as you explained means they can "walk away".

The officer, on the other hand, if he wishes to continue to ask questions as the person leaves the scene. The officer has to "DO IT WALKING".

Yes there are a lot of people that have overstayed visas. All of different skin colors.

ICE uses skin color, language, accent and job as their criteria.

Any one of which, will get a person stopped and questioned. Maybe even detained.
