Why DOGE is unconstitutional

If Trump and Musk manage to literally do what they are attempting to do, based on what I’ve seen in such a short time (like only what? 23 days so far?), that will dry up but quick.

It’s like Trump has discovered the vaccine to curing the diseased government.
He had 4 years of democrats fucking with him so I am sure democrats best go crawl back under their rocks

‘Even under the most aggressive view of the president’s “unitary executive” control over the entire executive branch and independent agencies, it is Congress’s sole authority to appropriate and legislate for our entire government. The president basically directs the executive branch within the contours prescribed by Congress, subject to constitutional checks and balances. To be sure, the president and Congress share policy responsibility because the president recommends budgets and necessary and expedient measures to Congress, whose bills the president can sign into law or veto. But in the end, the president is constitutionally stuck with the policies for the federal government that Congress enacts and appropriates. No one person in America is the law — not even a Trump or an Elon Musk.

So, how can the radical overhaul Trump and Musk are undertaking be reconciled with our constitutional order? Quite simply, it cannot be. Congress must step in to enact this radical transformation — or the Supreme Court must stop it.

In the past several years, the court has provided unmistakable direction that Congress, not the executive, determines the scope of federal policy. The court even narrowed the president’s previously long-held entitlement to deference when interpreting ambiguous laws and policies.

Specifically, the Trump-Musk quest for government efficiency is led by a “department” that Congress did not establish, by unelected operatives who exercise overwhelming authority without appointment under the appointments clause, who are not subject apparently to any checks and balances, who are not faithfully executing the laws Congress has appropriated and legislated, and who are in the process of eliminating whole agencies, programs and millions of employees without any congressional authorization whatsoever. And they are doing so without explaining and recommending such measures to Congress (or to the public, for that matter).’

There is no ‘DOGE’ – it is neither a department nor authorized agency; it is a lawless, un-Constitutional contrivance of Trump and Musk.
Let’s say you get your outcome avd DOGE goes away. Then, what is your plan to reduce Waste, Fraud, and Abuse while increasing Accountability? Is your plan to to go back to the status quo?

Waste, Fraud and Abuse score hire individually on the Lawless spectrum. This resonates more with the American Taxpayer than does your concerns about the Constitutionality of DOGE.

A long tedious cut and paste from a leftist tabloid.

Leftists are herding in their cry corners because the fraud, theft and waste they participated in and endorsed are being laid bare.

That's a pretty big deal.
That scares me even more than a "constitutional convention", if you consider the Slim Shadeys that would be in charge. 'Reinterpretation' would means even less transparency and no need for convening anything, just some up front money for some judges.

Yeah, scary thought, for sure.

One thing is for sure. And I've said it probably a guh zillion times, is that the anti-federalists have been proven correct over and over and over and over and over and over and over again throughout history.

They called it. And here we are...

/----/ We understand your desire to maintain waste, fraud, and abuse of tax payer dollars moving forward. But it's coming to an end.
Neither Congress nor the USSC have any jurisdiction over an advisory board.

EPA administrator Zeldin demands return of $20B in taxpayer money wasted by Biden administration

Zeldin said his team found $20 billion in taxpayer money 'parked at an outside financial institution'

The Environmental Protection Agency (EPA) administrator Lee Zeldin said Wednesday that his team has located $20 billion in tax dollars that the Biden administration purposely wasted.

"An extremely disturbing video circulated two months ago, featuring a Biden EPA political appointee talking about how they were ‘tossing gold bars off the Titanic,’ rushing to get billions of your tax dollars out the door before Inauguration Day," Zeldin said in a video posted to X, citing another video from December. "The ‘gold bars’ were tax dollars and ‘tossing them off the Titanic’ meant the Biden administration knew they were wasting it."

Zeldin said the EPA has plans to recover the "gold bars" that were found "parked at an outside financial institution," which he does not mention by name.

Democrats are against transparency because they are traitors working with the WEF on a plot to intentionally collapse America and usher in the great reset.

We sure don’t want to find misuse of spending, that would be terrible!

That is what you are saying, you are upset that the government is getting caught at wasting money. Had the Biden Administration found any wasted spending you would have supported it. You are a partisan hypocrite.

The United States Digital Service (USDS), was a technology unit[1][2] housed within the Executive Office of the President of the United States.

The USDS was launched on August 11, 2014 by President Barack Obama. It provided consultation services to federal agencies on information technology. Its mandate was to improve and simplify digital service, and to improve federal websites.[3][4][5][6] Its mission was to "To deliver better government services to the American people through technology and design."[7]

President Donald Trump issued an executive order on January 20, 2025, renaming and reorganizing the United States Digital Service as the United States DOGE Service.[8]

It was "legal and constitutional" when Obama did it, and TRUMP! just picked up what he laid down, renamed it and kicked it into high gear.
