Wrong - As police were looking for someone else they saw Scott breaking the law, smoking a blunt & possessing a gun. They ran his plate & description & discovered he had a record making it illegal for him to have a gun. The police were obligated to arrest Scott & called in backup. They did not have the right to kill Scott unless he threatened them with the gun.
Scott's hands were down as he backed away from his vehicle, but we couldn't see clearly the moment he was shot. Scott's wife said "Keith, don't you do it!!!" It's possible he had planned something or was maneuvering his gun in the direction of police. The cops might be cleared because of his wife's words on her video.

Smoking marijuana in your car is not minding your own business. It's violating the law. If the police observe you smoking, they will arrest you. If you refuse to comply and instead get out with a firearm and refuse to follow instructions, they will defend themselves. They gave him AMPLE opportunity to drop the gun.
