I'm not sure the law is unconstitutional for failing to specify there must be an intent to disseminate secret information or not, because there is an intent element in simply pushing the send button for the elec message. But, you are right that Comey declined to prosecute supposedly because Hill lacked specific intent to disclose secret matl. The FBI was forced to make a political decision because Slick compromised the AG.

But the whole "secret" thing itself was a political gotcha charge because of the lack of specific intent. It should be illegal for SoS to use personal email to solicit donations, esp from foreign countries, for her personal "foundation."

It also should be illegal for a pres candidate to send his sons and campaign manager to meet with a Russian spy to get dirt on his opponent, and we can all see where that is going too.
