I'm not sure the law is unconstitutional for failing to specify there must be an intent to disseminate secret information or not, because there is an intent element in simply pushing the send button for the elec message. But, you are right that Comey declined to prosecute supposedly because Hill lacked specific intent to disclose secret matl.

General Petreus was caught RED HANDED taking highly classified documents home so his journalist lover could have a go at them. Clear mishandling with ill intent and all he got was a probation.

given how the clinton family LOVES to play wordsmith games, i fail to believe she didn't know what she was doing in the same manner, just didn't care and believed like many - they are above the law and it would never come back to them.

none of us on either side should be above the law and we should not defend those who break the law for the biggest reason being - they're on our side and we don't want to give into the other side.

She wanted her own server out of convenience and political paranoia (Republicans were after her for a long time now after all), but that's not criminal intent. She was not out to distribute classified materials, not out to harm this country. At their core this is what the laws governing classified materials are there for and why a case was not brought against her.

The FBI Director acknowledged that Hillary broke the law but then said he wouldn't recommend an indictment because he didn't believe Hillary had any malicious intention. Hillary should have been prosecuted. Anyone else would have been prosecuted.
