You have captured a terrorist who has planted a NUCLEAR bomb in the middle of L.A. You know for an ABSOLUTE FACT that he planted it! Would you put his 18 month old son in a vat of boiling oil!!!??? Would you RAPE his 9 y/o daughter if front of him? Would you cut off his wife's TITS and wrap them on his head like ear muffs?

WASHINGTON (AP) — The Bush administration was under court order not to discard evidence of detainee torture and abuse months before the CIA destroyed videotapes that revealed some of its harshest interrogation tactics.

Normally, that would force the government to defend itself against obstruction allegations. But the CIA may have an out: its clandestine network of overseas prisons.

While judges focused on the detention center in Guantanamo Bay, Cuba, and tried to guarantee that any evidence of detainee abuse would be preserved, the CIA was performing its toughest questioning half a world away. And by the time President Bush publicly acknowledged the secret prison system, interrogation videotapes of two terrorism suspects had been destroyed.

The CIA destroyed the tapes in November 2005. That June, U.S. District Judge Henry H. Kennedy Jr. had ordered the Bush administration to safeguard "all evidence and information regarding the torture, mistreatment, and abuse of detainees now at the United States Naval Base at Guantanamo Bay."

YES!!!!!!! The CIA was ORDERED NOT to destroy the tapes!
 
"The public has a right to this information and the CIA must be held accountable for its flagrant disregard for the rule of law," Singh added.

In a release, the civil liberties group noted "the CIA had previously said it would only turn over documents from August 2002 that relate to the content of the videotapes. But U.S. District Court Judge Alvin K. Hellerstein of the Southern District of New York today ordered the CIA to produce records from April through December 2002 that relate to the content of the tapes, as well as documents from April 2002 through June 2003 that related to the destruction of the tapes and information about the persons and reasons behind their destruction."

"Judge Hellerstein also ordered the government to reconsider the extent of redactions it intends to make to the documents in light of last week's release, also as part of the ACLU's FOIA litigation, of four secret memos used by the Bush administration to justify torture," the release adds. "In addition, the court ordered the government to explain whether contempt proceedings would interfere with a federal criminal investigation into the destruction of the tapes led by prosecutor John Durham."

When our pilots were captured, they were considered to be criminals. The Vietnamese tortured our pilots to gain information that could save lives. That was their justification

Those who engage in torture always can find a reason to justify it. Somehow, the victim always deserves it

Those rights DO NOT apply to citizens of another country. That's why President Clinton started the CIA secret prison system and rendition.

Read your Constitution

The rights apply to the accused not accused Americans. If a foreign citizen commits a crime in the US, he is afforded the same rights as an American.

Read the Constitution again...."in the U.S." isn't the same as the battlefield in Afghanistan.

Last time I checked, the 9-11 attacks occured in the US, not Afghanistan. Doesn't matter where you catch them.
