No....there is more at stake.....you can't allow the judicial branch to tell the executive branch what to do with a power reserved to the executive branch......if you let them do it once, it sets a trend and later a prescedent....and then the courts will be conducting foreign policy or making decisions on foreign policy when it is not in their power to do so.....
