In order to qualify you must meet certain state requirements. the Republican and Democratic nominee meets them because the parties took care of that. The State cannot bar a qualified person from running. Trump qualifies because he is running under the umbrella of the Republican party.

the State does not get to enforce that so they can not use it dumbass. That would be like the State deciding the age limit was wrong and setting a new age limit.

states cannot enforce federal laws unless authorized by the federal Government or are you saying Texas was right about enforcing federal immigration laws? Congress not the states establish who is and is not qualified to run for President.

It's not s federal law, you dumbfuck. It's a Colorado state law to enforce the Constitution. No different than if Colorado ruled to keep a 30 30 year old off their ballot.

If he wins the election and has a republican congress I think he will try to amend the 22nd amendment allowing him to run a third time.

The Supreme Court ruled that an individual state may not disqualify a presidential candidate from the ballot under Section 3 of the 14th Amendment, which bars insurrectionists from regaining public office. All nine justices agreed with this bottom line. Five justices went further, however, declaring that only Congress may enforce Section 3 against federal candidates.

Section 3 Is Not Self-Executing and No Court Has the Authority to Enforce Section 3 Because Congress Has Not Passed a Federal Law Providing for Enforcement. In 1869, only one year after the Fourteenth Amendment was ratified, Chief Justice Chase held that Section 3 was not self-executing.

This is why there was 9-0 decision against Colorado. The law clearly shows that the lower court in Colorado did not have the authority to use section 3 of the 14 amendment to disqualify.
