I think you’re far too lenient.

Negligent homicide, to my understanding, deals with doing something stupid that results in killing someone. Like if you’re in my car, I‘m driving and under the influence, and get into an accident that ends up killing you.

Manslaughter is killing without malice, which is really the key word. I think there was clear malice as they just kept hitting him, intending to inflict bodily harm.

We’ll see.

For first and second degree murder, for the states that differentiate using those terms, one of the main determinants is intent.

It would be difficult to prove that the police intended to kill Mr Nichols.

Third degree isn't that far removed from manslaughter.

They may try to present that argument, but I could prove in a second that they did not. They never employed the first three steps.
 
Not because "they feel like it"...that was made clear in the ruling.

They must justify their actions if you were to sue them in civil court.

If your point is "they could lie"...what exactly can be done about that in ANY situation?

Well, yeah it is because they feel like it.

Here is what you posted...

One is...they have a reasonable suspicion that you are a flight risk.

And two...they have a reasonable suspicion that there is a risk of violence.

Both of those are based off feelings as they are 100% subjective.

That’s really not the premise of my post…you know that, you also know you can’t really respond to the true premise without proving yourselves foolish.

But I'd could make the argument that they did.

And if I can do it, a defense attorney could do it better.
