In this case there was no initial lack of cooperation. There was no verbal exchange between the officers and Nichols. He was not failing to cooperate.

I think you’re far too lenient.

Negligent homicide, to my understanding, deals with doing something stupid that results in killing someone. Like if you’re in my car, I‘m driving and under the influence, and get into an accident that ends up killing you.

Manslaughter is killing without malice, which is really the key word. I think there was clear malice as they just kept hitting him, intending to inflict bodily harm.
