Gallagher did not kill that terrorist, he was sentenced for doing something many soldiers do in combat zones as a form of humor, to get other soldiers to chillax about their moral guilt that comes naturally from killing the enemy. This way they will be less hesitant to pull the trigger and thus increase their chance of survival.
