There are procedures for declassification. A president cannot just disregard those procedures. The National Archive has documented 16 times where they made trump aware of those procedures and the steps he needed to take - under law - to declassify any documents.

Presidents can classify or declassify at will, but that has nothing to do with the documents Trump retained, because presidents can give out classified doc copies to whomever they want, without declassifying, including to themselves.

But if they were given to him by a president, they are perfectly legal to possess.
More than just Presidents and VP's -- other officials unerringly take documents they have to return. It happens often.

What does not happen ever (that we know of) are anyone refusing to return documents, lying to the FBI about it and ignoring federal subpoenas.

The old Ukrainian prosecutor, Shokin was deliberately and illegally fired because he had just STARTED investigating Burisma Holdings, and was not allowed to finish.
So there are NO OLD CASE FILES to go through.
Trump requested an investigation, and IT NEVER HAPPENED.
Clearly Hunter Biden got paid millions for doing absolutely NOTHING.
And since the replacement prosecutor was in on the scam, he of course is not going to find anything.

If this had bee a REAL investigation, then all receipts to and from Burisma Holdings would be made public.

Of course he can.
The classified docs laws are very explicit to totally exempt presidents and VPs, who much conduct diplomacy as they see fit.
And no one else gets any say.

The claim he was no longer president is pointless, since when president he can give copies to himself.
And the courts have already ruled executive privilege over classified docs never goes away.

The claim it violates NARA or PRA is also nonsense, since those are just based on FOIA, and are satisfied by copies from the original source, and do not require anything from, the president.

What Trump did instead was to simply extend his executive privilege to conduct diplomacy.
Same as if he gave a classified copy to a senator, ambassador, ally, etc.
He can do whatever he wants with them.

Until noon on his last day of his term (January 20). After that he no longer has Presidential privilege.

Hence his legal jeopardy with the MAL doc's since leaving office. He's admitted he still had classified documents after that date.

Read the laws.
That is what they not only clearly state, but it is obvious that is the only it could ever be.
All institutions or individuals that create or possess classified docs, do so at the pleasure of the president.
There is not a single classified doc law or regulation that ever says anything other than presidents, (and VPs)_, can do whatever they want with all classified docs.

Try reading some facts vs reading and regurgitating opinions and accusations.

Ukrainian prosecutors and anti-corruption activists with knowledge of the matter argue that the timeline of developments in the Burisma case and Shokin's stint as chief prosecutor simply does not fit the narrative being put forward by Trump and his allies.


Moreover, they say that Shokin himself was the biggest obstacle standing in the way of the investigation.

FPOTUS's ONLY have access by law to Presidential Records from their term. They do not have a blanket security clearance, nor do ex-Presidents have authority to create new classified documents, nor do ex-Presidents have authority to declassify. Those powers belong to the Office of the President and after noon on the last day of their term they are no long President.

Any access to classified information (outside their Presidential Records) located within the NARA is granted at the pleasure of the next (and subsequent) administrations. IIRC, the FPOTUS Trump isn't getting classified intelligence briefings because the current administration sees no value in it as the FPOTUS Trump wouldn't have any value insights to provide.
