That was the bittersweet pill in all of this. I think Roberts knew that the mandate was wrong, but he (correctly) recognized that the mandate was just another tax incentive. He saw that striking down the mandate would undermine the established practice of using the tax code as a carrot/stick to push people around. And he simply didn't have the balls to do it.
