As an innocent person just opening the door to see what the hell was going on, the man had no idea what danger he was in. I have great difficulty blaming the victim in this situation.

Like I said, the cops didn't know it was a fake call.

If you were a cop and a 911 dispatcher told you that there was a murder in progress, are you going to stop and ask them if they are sure it's not a prank? No, you are going to head to the call, thinking it's real. And, you are going to be prepared for someone with a weapon, which means your adrenaline is going to be pumping.

The poor kid that was shot had no idea what was going on. All he knew is that a SWAT team showed up at his house for no reason and started beating down the door. And, because he didn't know what was going on, he may not have complied like they told him to, resulting in him getting shot.

And, in most calls like this, the police have to clear the entire house to make sure there are no more dead people or weapons around.

If you want to blame someone, blame the idiot that called SWAT in the first place, not the cops who showed up thinking it was real.

That's murder, just as though the getaway driver gets charged when police catch the bank robber who killed a bank teller. The result of the crime was a homicide.

Of course that all depends on the state's law.

When the officer gives you directions, you follow them to the letter. It is unfortunate that someone was so stupid as to set this chain of events in action, but let's see what happens before we assign further blame that the mental midget who caused it to happen.

I volunteer with a group of people who train the military and law enforcement in these type of situations. Play stupid games, win stupid prizes. In the past 10 years, I have been "shot" once without due cause. The young man who did it was recycled through his training again.

But, you also have to remember that the police were first called because they were told it's a murder. Apparently, this happens about 400 times a year nationwide.

So, when the police start knocking on your door and you don't know why, you might be the victim of a swatting prank.

Humans are not robots. I can remember a one time after eating cereal for breakfast that I put the box of cereal in the refrigerator and the milk in the cabinate. Lucky for me that wasn’t a fatal mistake.

I would expect an innocent man opening the door under these circumstances to be completely clueless.

People move their hands around for many reasons or no reason. They make gestures without really thinking.
 
You know....................LOTS of you people are missing the point of why I posted this.

Were the cops at fault? Normally, I'd more than likely say yes, because most of the times that I've seen a cop related fatality, it WAS the cops fault. But in this case? No. I won't say that the police were at fault. Why? Because not only have I served in the military, but I was also part of the Security Force while stationed at Newport RI. We were taught about stuff like this. And, we were also taught that every time we were called to treat it like it's real. Same thing when we went to General Quarters, or when I was on the fire fighting parties. We were taught to treat each situation as if it was real, because you have to have those instincts honed in case the real situation happened.

One time, that training in the Navy not only saved a house, but probably saved a life as well. I had gone home with one of my shipmates, and his mother was cooking us lunch when the stove caught on fire. Well, both James and I were members of the fire fighting teams. We saw what was happening when his mom screamed, and because it was an electric stove, I told him to hit the fuse box because he lived there, and I took care of putting out the fire. About 30 sec. is all it took for us to take care of it.

The 911 operator was told that this was a real situation where someone had been killed. The 911 operator had no reason to think it was a prank, so they passed on the information to SWAT, who then went to the place specified. They were expecting a murder scene. And no, in cases of an active crime scene, no warrant is required.

The reason I posted this is to make some aware of the stupidity of some people. Yes, it is a tragedy that this dude was shot, but we don't know the circumstances. If there is video of it, we should look at that before accusing the police of being too forceful.

My opinion? The police officer did nothing wrong. Yes, a mistake was made, but we don't know what the guy did to cause the officer to shoot.

The asshole who should be nailed to a wall and left to bleed to death should be the moron who made the 911 call in the first place. Not only do I think he should be charged with murder, but if there is a death penalty for where he is, I hope they try for it.

Judging by the report indicating that only he fired his weapon... it seems at a glance that the officer over reacted, quite possibly flinched... one single shot? Doesn’t sound like shooting to stop a threat. Nor does it appear that even a single member of his team perceived a threat either...
