Supreme Court Screws Disabled Vets

We did this last evening.

It's not SCOTUS's job to make law or change rules, just interpret them to see if they pass muster constitutionally.....Evidently they found the one year after discharge rule passed muster.

If congress wants to amend the law/rules then that's on them, not SCOTUS.

I figure that's why SCOTUS took the case.....To remind congress of that fact. ;)

If you read the article...that rule has been waived in the past for good reason.

This Court said "screw em"
 
They never ruled that the VA could not waive the rule, just that the rule itself was solid.

That is what the plaintiffs were challenging.
WHAT?

They ruled against a disabled Vet on the basis of that rule.

That's precedent and any time the rule is challenged it will now be upheld because of this decision

Then the ball is back in congress's court to make law or the administration to "guide" the VA one way or the other.

Congress could have fixed this for decades.

That is nothing compared to when the Libtard Court in the 1970s said a woman could kill her child for the purpose of birth control. That resulted in almost a million children deaths each year and that was what you would call a court out of control.

How about when the filthy ass Court said that pubic school had to accept the goddamn Illegals? That really fucked up this country.

How about Brown V Board that created desegregation in the schools that resulted in the public schools being destroyed all over the country to accommodate the lowest denominator? Not to mention all that destructive busing and turmoil in our schools for decades?

It is a little more than that, this time. The actually set law to rule out extreme circumstance as being able to be considered, something that goes back to the earliest days of the Supreme Court, thus taking away grounds for appeal in all future cases, without consideration of right/wrong or the facts of the case.

Held: Section 5110(b)(1) is not subject to equitable tolling. Pp. 3–11.

(a) Equitable tolling “effectively extends an otherwise discrete limi-
tations period set by Congress” when a litigant diligently pursues his
rights but extraordinary circumstances prevent him from bringing a
timely action. Lozano v. Montoya Alvarez, 572 U. S. 1, 10. The Court
presumes that federal statutes of limitations are subject to equitable
tolling. See Irwin v. Department of Veterans Affairs, 498 U. S. 89, 95–
96. But this presumption is rebutted if equitable tolling is inconsistent
with the statutory scheme. Here, the Secretary of the VA argues that
§5110(b)(1) is not a statute of limitations and that, even if it were, any
applicable presumption in favor of equitable tolling is rebutted by the

§5110(b)(1) is a statute of limitations. Even assuming that the excep-
tion sets a limitations period, there exists “good reason to believe that
Congress did not want the equitable tolling doctrine to apply.” United

Disabled Vets. are better served by private institutions like T to T and Wounded Warriors than the confusing government system. Biden could fix what's apparently wrong at the stroke of a pen before it gets to the Supreme Court but he is too busy helping out a crooked regime like Ukraine.
