Look. I am at a disadvantage. I am one of the few posters on this site who is not an accomplished lawyer.

So I can choose to listen to some random poster on the internet who trips over his own arguement to satiate the need to inject insults at their perceived enemies...or I can simply read the case facts and compare it to the law.

I have chosen the latter.

At least when the appeal is rejected, you can fall back on the right wing tropes of "deep state", "RINO" and commie to avoid facing the fact that you don't know what you are talking about.

Rhodes can go ahead an appeal his conviction all he likes but while he does so his ass is going to sit in jail until sentencing and then he's going to prison to serve his sentence. If and when his appeal is heard he will still be in prison until the appeal is ruled on. I'm not sure what cosplay fantasy you imagine is going to see his conviction overturned but I'm sure it's hilarious.

What are the exceptions to the First Amendment?
a few narrow categories of speech are not protected from government restrictions. The main such categories are incitement, defamation, fraud, obscenity, child pornography, fighting words, and threats.

Most of those are actions, or lead to actions, not saying some guy is getting railroaded, which is what you want to punish.

Incitement: directions to perform criminal ACTS
Defamation: known lies that must be proven to be untrue, leading to some form of loss to the defamed.
Fraud: Economic damage.
Obscenity: This really is only punished nowadays over the airwaves, and it's not the words, it's the use of FCC regulated modes that is the issue. Even this isn't punished much anymore.
Child Porno: It's not the words being punished, it's the act itself, and any media resulting is also due to the ACTS
fighting words: One on one threat of violence, similar to incitement
threats: have to be viable, and potential to lead to again ACTS.

They all get their terms and thought processes from their alternate universe. They also try to use words that are used against them, whether the usage makes sense or not. So individual words are simply some variation on "bad".

Well, the Jan 6th committee sure seems to think so. Most Trump haters tell me the rioters were doing all this for Trump on his orders.
I am content to see how the legal process plays out. If they say Trump was implicated then fine. If they say he wasn't that's fine too.
