Former Otero County, New Mexico, Commissioner Couy Griffin was disqualified under the 14th Amendment's Section 3 in 2022 -- and that argument is being used against Trumpabcnews.go.com

Griffin's Section 3 case was a bench trial decided by a state judge and he has since twice appealed to the New Mexico Supreme Court, to no avail. Griffin was convicted of trespassing at the U.S. Capitol two years ago, though he said he did not enter the building with the mob. He was found not guilty of a disorderly conduct charge.
He has to be convicted if you intend to deprive him of life, liberty, or property. Nobody is doing that.
And what affects your right to vote for him. Every election Mickey Mouse gets thousands of votes and that name has never been on any ballot ever. You can vote for anyone you want. Every state has a write in option.
Just a thought - if we're voting for candidates who have done anything close to "insurrection", we have bigger problems.

You seem to forget. The founders and even those who wrote the 14th considered service to be an honor. The original plan was for the person who lost the election to be Vice President. They believed that the honorable man would be driven by patriotism to serve, even under another who had won the election.
