Social Security tells family to pay $100,000 debt left by man who faked death in 1960s

What part of that is wrong? They benefited from his death. Since he was not dead they should not have benefited.
Do you condone someone faking their death then collecting money from an insurance policy?
 
The guy faked his death to run off with his mistress. He did so to not break his wife’s heart or leave her without income. Wife & daughters had no idea & believed him dead when he never returned from a hunting trip.

Decades later, the shock of the betrayal killed the elderly mother who social security cut a deal with to just pay $10/ month until her death. After she quickly expired, SS changed its minds & tried to stick all the money to the daughters. Mother got $87k. Daughter 1 got $12k. Daughter 2 got $10k.

This is an attempt to force two adults to pay the debt of another adult they aren’t married to. Next will cousins be on the hook for agreements others signed? Friends? Neighbors? And the mother had zero part in the foul play. She was it’s chief victim.

Now, I have heard such things in the past. They should be going after the guys assets, not his innocent kids, or even his wife. If they can’t recover from him, then so be it.

Exactly. They're punishing the victims twice.

The guy hoodwinked them so they're out "to punish someone". That's the same as a serial killer being found dead and then grabbing on of his cousins and putting him on death row as a substitute to placate an irate prosecuting office.

They took no part in the crime. I would think there is a statute of limitation, or at least there should be. The judge rules one way which is purely symbolic, but alters his own ruling because an 89 year old woman dies (shocking). This is stupid.

What about the merchants who took the money from Madoff too? All the stuff he bought? Should they be forced to pay restitution?
 
I am glad the Social Security Administration changed their foolish position on this matter. Wether this change was a result of bad optics, shame, and/or a genuine reversal doesn’t matter really so long as they backed off.

Time is a factor. If a man steals money, in any manner, upon discover and conviction of the crime, reparations should be paid to the victims from the perpetrator. Also, any transaction directly spawned from the stolen money should be unwind. However, after some amount of time, it is impossible to unwind those transaction. The girls received $10k over 40 years ago. It’s impossible to retrace and unwind all the subsequent transactions from the original $10k. As for Madoff’s son, he likely was still living off the ill gotten funds, and thus those funds are fairly easy to recover.
