NO!!!!! What Nestor asserted is that "....the right to alter, amend, or repeal any provision of this [SS] Act is hereby reserved to the Congress..."
Now. if Congress wishes to negate the FICA payments made by an individual, THEN Congress will pay the political price for such a decision.
In other words, Nestor states that Congress may have the right to negate SS payments, BUT that particular Congress would pay the price....and that is why most congresses have avoided the issue lest those in that Congress will be out of a job (at best) and lynched (at worst.)
