What Happens if Congress Votes Not to Certify an Election

If Congress votes not to certify an election — specifically, if it objects to the Electoral College results — the process is governed by the Electoral Count Reform and Presidential Transition Improvement Act of 2022 and the Electoral Count Act of 1887.

    1. The objection process
After the Electoral College votes are counted in a joint session of Congress on January 6 (or a later date set by law), members of Congress may object to a state’s slate of electors. Under the 2022 law, the threshold for an objection is one-fifth of the members of both the House and Senate, not just one member per chamber Ballotpedia.

    2. Debate and voting
Once an objection is submitted, the House and Senate separate to debate for two hours. Each chamber must vote by simple majority to concur with the objection for it to stand Ballotpedia.

    3. If both chambers concur
If the objection is upheld and it results in no candidate receiving 270 electoral votes, the 12th Amendment triggers a contingent election:
    • House of Representatives: Each state delegation casts one vote for president, choosing among the top three candidates by electoral votes. A majority of state delegations (26) is needed to elect a president Thompson Coburn LLP.
    • Senate: Each senator casts one vote for vice president, choosing among the top two candidates by electoral votes Thompson Coburn LLP.
    • 4. If no president is elected by Inauguration Day

If no candidate wins a majority in the House by January 20, the vice president elected by the Senate in the contingent election becomes acting president until a new election is held Thompson Coburn LLP.

    5. Historical context
Congress has objected to electoral results only a few times since 1887. For example, in 1969, an objection to North Carolina’s vote was rejected by large margins in both chambers Ballotpedia.

    Key takeaway:
If Congress votes not to certify an election, it can block the count of a state’s electoral votes, potentially leading to a contingent election. But such an objection is rare, requires a high threshold of support, and must pass in both chambers before it can have any effect.

It’s hilarious how you paste all this info here that just shows you don’t know what you’re talking about.

No she is not

Add that to the list of things your are stupidly wrong about
Tulsi Gabbard is stepping down as Director of National Intelligence on June 30, 2026, to care for her husband, Abraham Williams, who has been diagnosed with a rare bone cancer.

Only an idiot would characterize it as such.
So you still deny the report shown to you that Director Tulsi Gabbard went after Obama? Should she have gone after Schiff and other Democrats? What they did while legal was a crime. They did not convict Trump and should never have impeached him.

How can something be legal but be a crime? What the hell are you talking about old man?

It is most assuredly not legal to LIE and change an ICA with contrived bullshit which leads to accusing your successor of collusion with Russia.
There was no lie. An intelligence assessment is a work of opinion. That’s what makes it an assessment. Of course a bunch of far right Republicans are going to disagree with that opinion.

Remember at the time that Trump was claiming Russia didn’t intervene in the election at all. That was the lie.

There was never good cause to impeach Trump.
Never.
Not once.
The Democrats are prostitutes who will do ANYTHING up to and including murdering Donald Trump to stop him.
Both impeachments were a joke, laughable. And yet the Dem sheep voted right along with their Commisars to pursue both ridiculous impeachments.
Trump wears them as a badge of courage, as well he should. I would too.

They bought some ads on Facebook for BOTH candidates.
There isn't a scintilla of evidence it had any effect whatsoever, tool.
