Replacing Ginsberg before the election isn't "unprecedented". Been done 19 times, with 17 confirmations.

But but but Dems own Ginsburg's seat they should get to fill it :206: :206: :206: :aargh::aargh::aargh:
but but the voters should decide..

Um ... they did. They elected Trump President and they elected the current Senate. And they are following the Constitutional process.

And stop lying. If Democrats were in power, this wouldn't even be a debate. Democrats would be setting up hearings and you'd be totally condescending to anyone who didn't like it and blow them off telling them elections have consequences.

Your argument is you just wwwwhhhhaaaaaaaaaaaaaaaa...nt it

They did. Voters elected Trump, and gave the Senate to the Republicans.

"Elections have consequences"-Barry Hussein Obama.

Democrats have hit a brick wall in delaying filling the seat. Naturally Pelosi threw a fit and has threatened the President with impeachment if he dares nominate someone. :cuckoo: :cuckoo: :cuckoo: :cuckoo: :cuckoo:
She is a complete hypocrite and a filthy whore.

Democratic Party has a problem with democracy in action.

Lets cut the partisan bullshit shall we if the Democrats had controlled the Senate in 2016 Merrick Garland would be on the Supreme Court right now they would not have waited till after the election if they controlled the Senate today they would not take up any nomination by Trump. Both parties are more than willing to use the power they hold to their advantage when suits them and be hypocrites when they don't and it doesn't.

Lets remember when conservative justice Scalia died Obama and the Dems threw a conniption fit when the GOP wouldn't let Obama fill that seat with a liberal. Now they pay the price, we are only doing what Dems advocated so hard should be done, fill the seat. Dems don't have a leg to stand on.

The voters did decide. They chose Trump and all the SC picks he can nominate. They also chose a republican majority in the Senate. They can vote on Trumps picks.

Exactly.

What a lot of nonsense in this thread. Although supreme court justices do generally vote in accordance with their ideological leanings those leanings are not near as strong as those that put them on the bench. Of course there are exceptions such as Ginsberg and Thomas. Judges are not politicians. They don't have agendas nor do they make political promises that they must fill and they are bound by codes of conduct that keep them out politics but they do have a commitment. And that committeemen is to confront every case with an open mind, to fully and fairly analyze the legal arguments that are presented, to considered the views of colleagues on the bench, and to decide every case based on it's record, according to the rule of law, without fear or favor.

Each political party would certainly try to put ethically corrupt judges on the bench that are willing to ignore the rules of law, the constitution, and facts of the case, to achieve their parities goals. However there are mechanism that help prevent this.
  • Senate hearings will expose the most blatantly unfair judges. This tends to keep the administration from knowingly nominating them.
  • Once on the bench, a judge's arguments and positions have to be defended before their peers in judicial discussions. The majority and minority opinions become public record and become part of case law. Those opinions are reviewed by law professors, legal societies, and judges throughout the country and will have a major impact on how history views their career.
  • Supreme Court Judges are appointed for life so they are are mostly immune to politician pressure from politicians, voters, and the public. However congress can remove a judge for bad behavior through the impeachment process. It's never been done but it is possible. Lastly, congress can change the law and in effect override most Supreme Court Decisions since most of those decisions are based on federal law.

This is not even a question it's a proven fact. Obama and Dems squealed like stuck pigs when Republicans refused to allow Obama to fill that seat. Now they are attempting a complete flip flop. This is the Dem's MO, flip positions and rules when it favors Dems, flip back when it doesn't.

The problem began when Senate Republicans refused to consider Obama's nomination of Garland 11 months before the election in 2106 citing a speech made by Biden in 1992 suggesting that nominations in an election year should be held back for the next president. Then in 2020 the Republican Senate flip flops and will consider a Trump nominee, only weeks before the election. This is wrong but it has become a new low politics, a precedent that will be carried forward with the next democrat controlled Senate and republican president.

This is a good example of why the country is going down the drain. There was a time, when this country was really great, when the two political parties put aside political difference to do the job they were elected to do. That was when things like Senatorial Courtesy, House Manners, and party coalitions existed. Today the priority in Washington is party, candidate, country.

Russian and Chinese election meddling is not about getting a US president favorable to their causes but rather getting a president that will increase distention and division, filling congressional seats with people whose primary purpose is to destroy their political enemies. They know a united America can't be beat, militarily nor economically.

It is the Republican Senate doing a flip flop, refusing to consider a democrat nominee 11 months before the election and considering a republican nominee weeks before an election. The Republicans should be excising at least a pretense of fairness.

Both situations have happened in the past numerous times.

Go get educated.

And when was the last time democrats refused to consider a republican nomination of a supreme court justice?

Since McConnell pulled his shit in 2016 it's a brand new game. This is what happens when republicans make the government work in new and interesting ways for partisan gain.

Look who's talking, DEMOCRATS asked Ginsburg to resign in an effort to RIG the seat e.g. let Obama fill it with a younger liberal while he had the votes to cram it through. YOU PEOPLE are in no position to preach to us so STFU.
Thr fact that most republicans don't care how they look right now is the prime reason they need to be voted out.

You're the one who's being totally fake. You know McConnell, like Biden in 92, was referring to when the presidency and senate were in different hands.

Stop the lies, it's tired
His technicality argument sounds like something a sleazy mob lawyer would come up with. McConnell stole a SC pick because he could and now by his own rule is going to try to steal another. It's banana republic bullshit. A naked power grab. It's sad how many Americans have forgotten that this is not how it's supposed to be.

But Democrats aren't like that. You actually believe in 1992 that Biden meant he wouldn't confirm a DEMOCRAT nominee. You're actually claiming that?

Presidential terms are four years. Senate terms are six years. The President has the power to nominate, the Senate has the Constitutional power of "advice and consent." You're arguing banana republics follow their own Constitution, which is a pile of stinking garbage.

I actually don't really have a problem with what Biden said in 1992. I find it hard to believe the parties could agree on a nominee in an election year. But it's your endless overt HYPOCRISY that is a stinking pile of cow manure.

You are EXACTLY the same and would do EXACTLY the same. Get the fake indignation out of here and grow a pair, Petunia

And this is why the US is dying...it's exceptionalism is slowly sinking into the mire....

Huh. So you're with the Democrats on this one. Like every other issue. I mean what are the odds since you're not a Democrat??? It has to be astronomical!!!!

Do you have any point behind that or you're just here to hear yourself whine?

Right because Dems are fair if nothing else and would do the same if in our shoes. What a giant LOAD OF SHIT! :eusa_hand:

No, not really. I mean, I see the Dem's point and McConnell's glaring hypocrisy. However, wouldn't it be great to discuss the merits of a USSC nominee on their ability as a jurist, not their supposed party affiliation? And that is why the US is sliding into irrelevance. It'll take a few more decades for it to happen but it will happen. Because now all that matters is the political aspects of your institutions, not what they are actually doing or why they were created in the first place.

That joke? We usually swap New Zealand with Australia...;o)
