Queens man gets four years for shooting a mugger

Perhaps you should have paid more attention to the thread, he wasn't convicted of the shooting, he was convicted of unconstitutional weapons possession charges, 26 counts.

And I hope he appeals it to SCOTUS, if you have to pay the State to own a firearm then it's not a right as defined in the Constitution, it's an infringement on that right.

Most pleas in NYC (to any reduced crime, etc) are conditioned by the prosecutors to a “waiver of the right to appeal.”

This doesn’t always prevent the defendant from appealing all issues. But I suspect? here, that he won’t have his appeal (if he tries) entertained by the appellate courts.

It’s a case that sharply frames the problem: you cannot have any unlicensed handgun, but if he hadn’t been carrying that unlicensed gun he might have been killed, instead. And yes, a stab to the throat could easily cause death if it hit the right spot.

A 67-year-old man who fatally shot a would-be mugger during a robbery gone wrong has been jailed for four years.

Charles Foehner, from Queens, New York, appeared stone-faced as he arrived at Queens County Criminal Court Thursday morning for sentencing.

Foehner, a retired doorman, was walking to a parking garage outside his Queens apartment when the alleged mugger lunged at him with a sharp object about 2am on May 31, 2023.

In most states the mugging victim would probably walk.
NY seems to favor the criminal over the victim.
Society will eventually break down if crime gets out of hand.
Places like New York and California literally favor the criminal over the victim. It's not an exercise in wordsmithing to say that ... it's simply fact.
This is how you lose a nation.
Criminals increasingly act with impunity, knowing they will not be severely punished ... or punished at all.
And good citizens, regular Joes, lose faith in the system and give up on the idea of even bothering to defend themselves. Because they will be actively prosecuted for merely protecting themselves or that of their family.
It is utter madness. And we see it every day in the blue states. District Attorneys, many of them financed by George Soros, purposely warp the law to favor criminals and to crush the will of the good citizens of this country.
It's one reason why Concealed Carry Insurance has become a very hot item anymore. It's one of those things that shouldn't even be necessary in a nation where the law makes sense but as we know, that's increasingly becoming a rarity.
 
In a Far Left jurisdiction like NYC, I can see where he would take a deal, a jury would probably want to send Mr. Foehner to the chair for shooting one of Queens' criminals.

But I'd like to know who snitched on him? If I had seen the shooting, I would have never come forward. I can't imagine the police spending much time on an obvious "public service" death.

Why if you witnessed him shooting the perp, how would you testify his gun was illegally in his possession? You would not know anything except he shot the perp, of which he was NOT convicted. You didn't get the story. I suggest reading it again.

I don't think so, but then maybe I'm missing something.
 
What was "questionable" about the shooting?

A known piece of poop with a record as long as his arm gets shot by a law-abiding senior citizen.

Sort of an expected shooting, really. The robber was on a one way trip to the morgue before he left his house that day.
He was armed with a ballpoint.

Ratted him out on the shooting? You need to read the story and knock off the drugs! Do you think he shot a mugger and then walked home as if nothing happened?
