Actually, the constitution makes NO MENTION OF GENDER at all, except for the 19th Amendment giving women the right to vote. In fact, the whole argument against the ERA was that it would eliminate any special exemptions for women. (Which, again, seems silly now that we have women in foxholes and men in lady's rooms without having an ERA.)
