She can't be prosecuted because Congress protected themselves from inside trading laws by allowing unlimited trades with no exception if the trade was made by a spouse.18 U.S. Code § 208 - Acts affecting a personal financial interest - she violated BOTH and should be prosecuted and forced to resign or be expelled.
