Frankly, who cares if she goes home with a US citizen baby. That might be a problem in 18 years, assuming that person really wants to exercise that right.

Let's go back to our hypothetical of Baby Chen. So, if baby Chen's parents had the means to afford a flight to the US or a US territory, they would probably have the means to give Chen a really good education to become a scientist or a doctor when he grows up.

Then we will WANT him to come back, won't we?

FACT: As currently interpreted, it is terrible public policy.

The court should latch onto the ambiguity of the text [A pox on ANYONE who claims that birthright citizenship is "in the Constitution." It is NOT], and reinterpret it to good public policy as follows: The text should highlight the word, "…reside.." at the end and state that illegals in the country do not RESIDE in the country in any meaningful way.

But they won't do that, and the only real speculation is how they will worm their way out of doing the right thing. They will NOT say that a Constitutional Amendment is required to correct the error, but they could throw it back to Congress to clarify by law.

Well, he and Schitler probably have a point that the Conservative justices might punt by ruling on a procedural ground, which will just encourage Mango Mussolini to try other means to screw with immigrant parents.

We are losing our freedoms. Our whole government is now centered on paying people off for any reason possible as they can live any way they want. In the end we will have people ruling us who stop much of that in a poorer environment. Real inflation is higher than what is reported and has been for many many years.

Please cite your eloquent logic in the text of the Constitutional amendment that has been the law of the land since 1868.

I will also ask, what is the problem? Seems to me, the problem would be with the country the birth tourist is from.

WTF, someone is going to come over here from, say, China, pop out a baby that is now an American citizen, run back home, and twenty years later that Chinese raised American born citizen is going to show up, demand his citizenship, and take over the damn country for his motherland, China.

Seriously? You believe that is going to happen? No. Typically, birth tourist are wealthy individuals seeking "options". The first probably came out of the falling Soviet Union as the oligarchs sought an escape. Now, many are the children of Chinese coal barons. They are seeking options.

I hate to break it to you. But Harvard, Yale, Stanford, MIT--those are fallback schools for top students in China, or India for that matter. There, the academic landscape is challenging and, sad to say, more equitable. The top students go to the State schools on the State's dime. Wealthy students often lose out, that is when they come here.

Look, it ain't easy being a foreign student studying in the US. One thing is for damn sure, it takes money, lots of money. Those students pay full boat, live in luxury off campus apartments, drive Bentleys, and pump millions of dollars into local economies. Being a US citizen would be a huge advantage.

I mean can we get real for a moment. Trump wants to hawk US citizenship, like a damn Express Card, and sell them for millions of dollars. So who can blame a relatively well off Chinese national for dropping six figures to have a child born an American citizen. And I got to ask, who the hell is going to invest at least 18, probably 20 plus years, creating a magical Almighty sleeper cell when they can just throw down a few million and get the red carpet treatment TODAY.

So our first option is try to pass some laws via congress that can define "under the jurisdiction thereof" and clarify the situation, and the 2nd longer option is an amendment removing it.
Congress does not have the authority to define what was meant by “jurisdiction thereof” in the constitution. That’s up to the Supreme Court one day ever decide to get there. A law doesn’t cut it.
