Funny how a constitutional lawyer doesn't understand the concept of separation of powers and role the Supreme Court Plays in interpreting the Constitution and Bill of Rights. If not for the Supreme Court we would not have any rights or freedoms as guaranteed by the Constitution and Bill of Rights, FDR would have done away with those years ago.

The Federalist Papers have no power, they are simply letters to the editor. And Bork's agreeing is the same as any citizen agreeing.At this time the health care act is the law of the land. The president has signed the bill passed by both houses of Congress. The Congress was elected by the people and supposedly carry out the people's will.
The Constitution never spelled out the power of the Supreme Court to declare laws unconstitutional, the Court simply assumed that power in a famous case, Marbury v. Madison.
So far, I have seen nothing that indicates Obama does not understand the Constitution, but there does seem some confusion on these boards.

I will point out that Rober Bork sides with Marshall in his famous ruling. However, what is not clear is the enforcement power he supports.
In the end, though, Obama can't possibly ignore he fact that the USC was intended to limit the powers of the fed.
The federalist papers make that clear.
He should have never campaigned for, pushed for, and signed this bill or any bill related to health care.

Why is there even an amendment procedure within the constitution if what the president says is true? If a majority of congress can pass a bill and it therefore immediately becomes constitutional then why is there even a section on amendments? Our president is supposed to be a constitutional professor you would think he would know that.

President Barack Obama voiced confidence Monday that the Supreme Court will uphold his health care law in his first public remarks on the issue since the three days of oral arguments last week.
In a rare instance of a president weighing in on a high court case in which the ruling has not yet been released, Obama suggested that the high court would be guilty of judicial activism if it overturned the law. He also argued that the justices should uphold the individual mandate, saying its a key and constitutional piece of the law.
We are confident that this will be upheld because it should be upheld, Obama said at a joint news conference at the White House with Canadian Prime Minister Stephen Harper and Mexican President Felipe Calderon.
