Model Prosecution Memo for Trump Classified Documents

Works for me.

Trump's conduct was a lot more egregious.

But getting Trump on this is like getting Al Capone on income tax evasion. You know that he's done much worse stuff, but this is the path of least resistance.
You know, heh?

Of course they can convict, along with Obama, Biden, Pence, and many others. The question is, are they only going to prosecute one person instead of everyone?
Because Trump is the only one with any evidence that he broke the law.

Biden and Pence both had classified documents but no evidence they took them knowingly and willingly.

Trump on the other hand decided to play stupid games with the DoJ and now he gets to win stupid prizes.

Bullshit. Biden had documents in his possession from when he was a senator. Documents he should NEVER have had.

Yes, well we know that you can't play games with Biden's run DOJ.

The whole purpose of this prosecution is to impair President Trump's campaign for 2024. Nothing more. There are no crimes, nothing that any ethical prosecutor would waste time on.

As a hilarious aside, former FBI director James Comey predicted the other day that if Trump won the Presidency in 2024, he would "politicize DoJ."

Un.
Fucking.
Believable.
Sorry but are wrong...

Not only are the crimes Trump could be charged with serious but people have gone to jail in the past for these same crimes...

Trump was right about one thing, he could have shot someone and you wouldn't convict him...

What is political of prosecuting a crime? If they have the evidence then prosecute...

It was highly unlikely Hillary would have been convicted (due to it being standard practice by her predecessors)...

Trump looks like he is serious water for obstructing justice..

It happens frequently. A few classified documents can easily get intermingled with other documents.

It happens NEVER!! IT IS A FELONY FOR A SENATOR TO HAVE CLASSIFIED DOCUMENTS IN HIS POSSESSION!

It happens NEVER!! IT IS A FELONY FOR A SENATOR TO HAVE CLASSIFIED DOCUMENTS IN HIS POSSESSION!
It's only recently a felony and it's only ever been illegal if the documents are taken knowingly and willingly.

It has happened over 80 times in the last decade based on the testimony of NARA COO.

Trump's lawyers met with the Justice Department today to beg the DOJ not to prosecute their client. Due to the surfeit of evidence of Trump's crimes surrounding classified documents, it is highly doubtful the attorneys succeeded in their mission.

Below is an analysis of what a prosecution memo will look like.

Before indicting a case, prosecutors prepare a prosecution memo (or “pros memo”) that lays out admissible evidence, possible charges, and legal issues. This document provides a basis for prosecutors and their supervisors to assess whether the case meets the standard set forth in the Federal Principles of Prosecution, which permit prosecution only when there is sufficient evidence to obtain and sustain a conviction. Before a decision is made about bringing charges against Trump (and co-conspirators, if any), prosecutors will prepare such a memo.

There is sufficient evidence to obtain and sustain a conviction here, if the information gleaned from government filings and statements and voluminous public reporting is accurate.

Our memo analyzes six federal crimes in depth:

Mishandling of Government Documents
1. Retention of National Defense Information (18 U.S.C. § 793(e))
2. Concealing Government Records (18 U.S.C. § 2071)
3. Conversion of Government Property (18 U.S.C. § 641)

Obstruction, Contempt, False Information

1. Obstruction of Justice (18 U.S.C. § 1519)
2. Criminal Contempt (18 U.S.C. § 402)
3. False Statements to Federal Investigators (18 U.S.C. § 1001)

Nope. They arent going to charge him for taking documents. If they did that they would have to charge Biden too, which they wont do. They will charge him for "obstruction of justice" instead. Its a nice little work around to fuck over Trump, while at the same time keeping Biden safe.

Unless you are on the grand jury there is no way you can know if there were crimes or not because you don't have access to all the testimony and evidence.

All your post shows is due to political bias, you have already made up your mind.

He didn't steal them, they were packed for him by an aid accidentally and Biden did not know he had them...but I suspect you already know this.
The assistant had clearance to see classified documents? Biden shared classified documents with an assistant?

Are you being deliberately obtuse?

The assistant found the documents. Reported it. Biden didn't knowingly share anything.

Here is the testimony you seem to have missed or ignored or simply weren't exposed to in your echo chamber.

"According to a partial transcript from Democratic staff on the committee, Chung testified that she and another Biden assistant, Ann Marie Person, worked quickly to help pack up the vice presidential office before Donald Trump took office. She testified that she didn't notice any classified material at any point in the process. Chung said she had a security clearance and experience handling classified material while she was in the vice president's office.

Chung said she packed about 13 boxes at the White House, at the time believing that all presidential and classified material had already been turned over to the appropriate offices.
She said she placed folders in the boxes and did not examine the papers inside the folders. They also packed boxes with items such as challenge coins, personal correspondence, condolence letters, schedule copies, copies of past speeches and some other photos and documents.

The boxes, Chung said, were taken to a General Services Administration transition facility near the White House, where they stayed for six months. They were then moved to a building in Washington's Chinatown neighborhood that was leased by the Penn Biden Center before eventually being moved to the think tank's main office space.

Chung, who was Mr. Biden's aide during the Obama administration and continued working for him once he left the White House, said she unpacked the boxes at Mr. Biden's Penn Biden Center office, placing some of the file folders in a cabinet. She testified that she didn't rifle through the papers individually as she unpacked."

Surely you want to hear the evidence against Joe.......or do you just want you keep swallowing him?
