I can detain someone hindering and near my operations if I feel in my discretion has the potential to harm my officers especially if he has been following them.

There’s a possibility that they could justify detaining him, but they clearly went well beyond that. They had previously approached him and told him he can’t follow them, but that’s not the law.


They physically assaulted him, ripped him out of the car and arrested him, holding him for 8-10 hours before releasing him.

That’s not detaining. That’s an arrest. Arrest requires probable cause of a crime. There was no crime.

When they want after Renee Good, their first move was to rip her out of the car, so we have plenty of evidence to the contrary.

By the time this man reached the parking lot, ICE had decided to arrest him as they had previously warned they would do if he continued to follow them.

The problem is that it’s not illegal to follow them around, which means the arrest was unjustified and illegal.
